77 relating to the liability of certain social workers who provide
88 volunteer health care services to charitable organizations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subdivision (5), Section 84.003, Civil Practice
1111 and Remedies Code, is amended to read as follows:
1212 (5) "Volunteer health care provider" means an
1313 individual who voluntarily provides health care services without
1414 compensation or expectation of compensation and who is:
1515 (A) an individual who is licensed to practice
1616 medicine under Subtitle B, Title 3, Occupations Code;
1717 (B) a retired physician who is eligible to
1818 provide health care services, including a retired physician who is
1919 licensed but exempt from paying the required annual registration
2020 fee under Section 156.002, Occupations Code;
2121 (C) a physician assistant licensed under Chapter
2222 204, Occupations Code, or a retired physician assistant who is
2323 eligible to provide health care services under the law of this
2424 state;
2525 (D) a registered nurse, including an advanced
2626 nurse practitioner, or vocational nurse, licensed under Chapter
2727 301, Occupations Code, or a retired vocational nurse or registered
2828 nurse, including a retired advanced nurse practitioner, who is
2929 eligible to provide health care services under the law of this
3030 state;
3131 (E) a pharmacist licensed under Subtitle J, Title
3232 3, Occupations Code, or a retired pharmacist who is eligible to
3333 provide health care services under the law of this state;
3434 (F) a podiatrist licensed under Chapter 202,
3535 Occupations Code, or a retired podiatrist who is eligible to
3636 provide health care services under the law of this state;
3737 (G) a dentist licensed under Subtitle D, Title 3,
3838 Occupations Code, or a retired dentist who is eligible to provide
3939 health care services under the law of this state;
4040 (H) a dental hygienist licensed under Subtitle D,
4141 Title 3, Occupations Code, or a retired dental hygienist who is
4242 eligible to provide health care services under the law of this
4343 state;
4444 (I) an optometrist or therapeutic optometrist
4545 licensed under Chapter 351, Occupations Code, or a retired
4646 optometrist or therapeutic optometrist who is eligible to provide
4747 health care services under the law of this state;
4848 (J) a physical therapist or physical therapist
4949 assistant licensed under Chapter 453, Occupations Code, or a
5050 retired physical therapist or physical therapist assistant who is
5151 eligible to provide health care services under the law of this
5252 state;
5353 (K) an occupational therapist or occupational
5454 therapy assistant licensed under Chapter 454, Occupations Code, or
5555 a retired occupational therapist or occupational therapy assistant
5656 who is eligible to provide health care services under the law of
5757 this state; [or]
5858 (L) an audiologist, assistant in audiology,
5959 speech-language pathologist, or assistant in speech-language
6060 pathology licensed under Chapter 401, Occupations Code, or a
6161 retired audiologist, assistant in audiology, speech-language
6262 pathologist, or assistant in speech-language pathology who is
6363 eligible to provide health care services under the laws of this
6464 state; or
6565 (M) a social worker licensed under Chapter 505,
6666 Occupations Code, or a retired social worker who is eligible to
6767 engage in the practice of social work under the law of this state.
6868 SECTION 2. This Act applies only to a cause of action that
6969 accrues on or after the effective date of this Act. A cause of
7070 action that accrued before the effective date of this Act is
7171 governed by the law applicable to the cause of action immediately
7272 before the effective date of this Act, and that law is continued in
7373 effect for that purpose.
7474 SECTION 3. This Act takes effect September 1, 2013.
