6	6	AN ACT
7	7	relating to the liability of certain social workers who provide
8	8	volunteer health care services to charitable organizations.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Subdivision (5), Section 84.003, Civil Practice
11	11	and Remedies Code, is amended to read as follows:
12	12	(5) "Volunteer health care provider" means an
13	13	individual who voluntarily provides health care services without
14	14	compensation or expectation of compensation and who is:
15	15	(A) an individual who is licensed to practice
16	16	medicine under Subtitle B, Title 3, Occupations Code;
17	17	(B) a retired physician who is eligible to
18	18	provide health care services, including a retired physician who is
19	19	licensed but exempt from paying the required annual registration
20	20	fee under Section 156.002, Occupations Code;
21	21	(C) a physician assistant licensed under Chapter
22	22	204, Occupations Code, or a retired physician assistant who is
23	23	eligible to provide health care services under the law of this
24	24	state;
25	25	(D) a registered nurse, including an advanced
26	26	nurse practitioner, or vocational nurse, licensed under Chapter
27	27	301, Occupations Code, or a retired vocational nurse or registered
28	28	nurse, including a retired advanced nurse practitioner, who is
29	29	eligible to provide health care services under the law of this
30	30	state;
31	31	(E) a pharmacist licensed under Subtitle J, Title
32	32	3, Occupations Code, or a retired pharmacist who is eligible to
33	33	provide health care services under the law of this state;
34	34	(F) a podiatrist licensed under Chapter 202,
35	35	Occupations Code, or a retired podiatrist who is eligible to
36	36	provide health care services under the law of this state;
37	37	(G) a dentist licensed under Subtitle D, Title 3,
38	38	Occupations Code, or a retired dentist who is eligible to provide
39	39	health care services under the law of this state;
40	40	(H) a dental hygienist licensed under Subtitle D,
41	41	Title 3, Occupations Code, or a retired dental hygienist who is
42	42	eligible to provide health care services under the law of this
43	43	state;
44	44	(I) an optometrist or therapeutic optometrist
45	45	licensed under Chapter 351, Occupations Code, or a retired
46	46	optometrist or therapeutic optometrist who is eligible to provide
47	47	health care services under the law of this state;
48	48	(J) a physical therapist or physical therapist
49	49	assistant licensed under Chapter 453, Occupations Code, or a
50	50	retired physical therapist or physical therapist assistant who is
51	51	eligible to provide health care services under the law of this
52	52	state;
53	53	(K) an occupational therapist or occupational
54	54	therapy assistant licensed under Chapter 454, Occupations Code, or
55	55	a retired occupational therapist or occupational therapy assistant
56	56	who is eligible to provide health care services under the law of
57	57	this state; [or]
58	58	(L) an audiologist, assistant in audiology,
59	59	speech-language pathologist, or assistant in speech-language
60	60	pathology licensed under Chapter 401, Occupations Code, or a
61	61	retired audiologist, assistant in audiology, speech-language
62	62	pathologist, or assistant in speech-language pathology who is
63	63	eligible to provide health care services under the laws of this
64	64	state; or
65	65	(M) a social worker licensed under Chapter 505,
66	66	Occupations Code, or a retired social worker who is eligible to
67	67	engage in the practice of social work under the law of this state.
68	68	SECTION 2. This Act applies only to a cause of action that
69	69	accrues on or after the effective date of this Act. A cause of
70	70	action that accrued before the effective date of this Act is
71	71	governed by the law applicable to the cause of action immediately
72	72	before the effective date of this Act, and that law is continued in
73	73	effect for that purpose.
74	74	SECTION 3. This Act takes effect September 1, 2013.
