| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 181.041, Utilities Code, is amended by |
|---|
| 10 | 10 | | adding Subdivisions (3) and (4) to read as follows: |
|---|
| 11 | 11 | | (3) "Distribution line" means a power line operated |
|---|
| 12 | 12 | | below 60,000 volts when measured phase to phase. |
|---|
| 13 | 13 | | (4) "Transmission line" means a power line operated at |
|---|
| 14 | 14 | | 60,000 volts or more when measured phase to phase. |
|---|
| 15 | 15 | | SECTION 2. Subsection (a), Section 181.045, Utilities Code, |
|---|
| 16 | 16 | | is amended to read as follows: |
|---|
| 17 | 17 | | (a) A municipal electric utility shall construct, operate, |
|---|
| 18 | 18 | | and maintain its transmission lines and distribution lines [for the |
|---|
| 19 | 19 | | transmission and distribution of electric energy] along highways |
|---|
| 20 | 20 | | and at other places in accordance with the national electrical |
|---|
| 21 | 21 | | safety code. With regard to clearances, an electric utility that is |
|---|
| 22 | 22 | | not a municipal electric utility shall construct, operate, and |
|---|
| 23 | 23 | | maintain its transmission lines and distribution lines [for the |
|---|
| 24 | 24 | | transmission and distribution of electric energy] along highways |
|---|
| 25 | 25 | | and at other places in accordance with the national electrical |
|---|
| 26 | 26 | | safety code. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2013. |
