88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 181.041, Utilities Code, is amended by
1010 adding Subdivisions (3) and (4) to read as follows:
1111 (3) "Distribution line" means a power line operated
1212 below 60,000 volts when measured phase to phase.
1313 (4) "Transmission line" means a power line operated at
1414 60,000 volts or more when measured phase to phase.
1515 SECTION 2. Subsection (a), Section 181.045, Utilities Code,
1616 is amended to read as follows:
1717 (a) A municipal electric utility shall construct, operate,
1818 and maintain its transmission lines and distribution lines [for the
1919 transmission and distribution of electric energy] along highways
2020 and at other places in accordance with the national electrical
2121 safety code. With regard to clearances, an electric utility that is
2222 not a municipal electric utility shall construct, operate, and
2323 maintain its transmission lines and distribution lines [for the
2424 transmission and distribution of electric energy] along highways
2525 and at other places in accordance with the national electrical
2626 safety code.
2727 SECTION 3. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2013.
