77 relating to the storage of certain imported alcoholic beverages.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 55.03, Alcoholic Beverage Code, is
1010 amended to read as follows:
1111 Sec. 55.03. ELIGIBILITY FOR PERMIT. A manufacturer's
1212 agent's warehousing permit may be issued to an entity:
1313 (1) that receives beer, ale, or malt liquor from [of
1414 which at least 50 percent of the ownership interests are owned by]
1515 another entity, or that other entity's immediate successor in
1616 interest, that:
1717 (A) is located and chartered in the United
1818 Mexican States;
1919 (B) has held a nonresident manufacturer's
2020 license, nonresident brewer's permit, and a nonresident seller's
2121 permit for the two years preceding the date of the application; and
2222 (C) during each of those two years has shipped or
2323 caused to be shipped into this state for ultimate sale to qualified
2424 distributors and wholesalers in this state at least one-half
2525 million barrels of beer, ale, or malt liquor of the various brands
2626 manufactured or brewed by the entity; and
2727 (2) whose employees, located in this state or
2828 elsewhere, hold permits and licenses issued under Chapters 36 and
2929 73 to perform the activities authorized under those chapters on
3030 behalf of the entity.
3131 SECTION 2. This Act takes effect September 1, 2013.
