| 7 | 7 | | relating to the storage of certain imported alcoholic beverages. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 55.03, Alcoholic Beverage Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | Sec. 55.03. ELIGIBILITY FOR PERMIT. A manufacturer's |
|---|
| 12 | 12 | | agent's warehousing permit may be issued to an entity: |
|---|
| 13 | 13 | | (1) that receives beer, ale, or malt liquor from [of |
|---|
| 14 | 14 | | which at least 50 percent of the ownership interests are owned by] |
|---|
| 15 | 15 | | another entity, or that other entity's immediate successor in |
|---|
| 16 | 16 | | interest, that: |
|---|
| 17 | 17 | | (A) is located and chartered in the United |
|---|
| 18 | 18 | | Mexican States; |
|---|
| 19 | 19 | | (B) has held a nonresident manufacturer's |
|---|
| 20 | 20 | | license, nonresident brewer's permit, and a nonresident seller's |
|---|
| 21 | 21 | | permit for the two years preceding the date of the application; and |
|---|
| 22 | 22 | | (C) during each of those two years has shipped or |
|---|
| 23 | 23 | | caused to be shipped into this state for ultimate sale to qualified |
|---|
| 24 | 24 | | distributors and wholesalers in this state at least one-half |
|---|
| 25 | 25 | | million barrels of beer, ale, or malt liquor of the various brands |
|---|
| 26 | 26 | | manufactured or brewed by the entity; and |
|---|
| 27 | 27 | | (2) whose employees, located in this state or |
|---|
| 28 | 28 | | elsewhere, hold permits and licenses issued under Chapters 36 and |
|---|
| 29 | 29 | | 73 to perform the activities authorized under those chapters on |
|---|
| 30 | 30 | | behalf of the entity. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect September 1, 2013. |
