77 relating to the practice of cosmetology.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1602.002, Occupations Code, is amended
1010 by amending Subsection (a) and adding Subsection (a-1) to read as
1111 follows:
1212 (a) In this chapter, "cosmetology" means the practice of
1313 performing or offering to perform for compensation any of the
1414 following services:
1515 (1) treating a person's hair by:
1616 (A) providing any method of treatment as a
1717 primary service, including arranging, beautifying, bleaching,
1818 cleansing, coloring, cutting, dressing, dyeing, processing,
1919 shampooing, shaping, singeing, straightening, styling, tinting, or
2020 waving;
2121 (B) providing a necessary service that is
2222 preparatory or ancillary to a service under Paragraph (A),
2323 including bobbing, clipping, cutting, or trimming a person's hair
2424 or shaving a person's neck with a safety razor; or
2525 (C) cutting the person's hair as a separate and
2626 independent service for which a charge is directly or indirectly
2727 made separately from charges for any other service;
2828 (2) weaving or braiding a person's hair;
2929 (3) shampooing and conditioning a person's hair;
3030 (4) servicing a person's wig or artificial hairpiece
3131 on a person's head or on a block after the initial retail sale and
3232 servicing in any manner listed in Subdivision (1);
3333 (5) treating a person's mustache or beard by
3434 arranging, beautifying, coloring, processing, styling, [or]
3535 trimming, or shaving with a safety razor;
3636 (6) cleansing, stimulating, or massaging a person's
3737 scalp, face, neck, or arms:
3838 (A) by hand or by using a device, apparatus, or
3939 appliance; and
4040 (B) with or without the use of any cosmetic
4141 preparation, antiseptic, tonic, lotion, or cream;
4242 (7) beautifying a person's face, neck, or arms using a
4343 cosmetic preparation, antiseptic, tonic, lotion, powder, oil,
4444 clay, cream, or appliance;
4545 (8) administering facial treatments;
4646 (9) removing superfluous hair from a person's body
4747 using depilatories, preparations, or tweezing techniques;
4848 (10) treating a person's nails by:
4949 (A) cutting, trimming, polishing, tinting,
5050 coloring, cleansing, or manicuring; or
5151 (B) attaching false nails;
5252 (11) massaging, cleansing, treating, or beautifying a
5353 person's hands or feet; or
5454 (12) applying semipermanent, thread-like extensions
5555 composed of single fibers to a person's eyelashes.
5656 (a-1) In this section, "safety razor" means a razor that is
5757 fitted with a guard close to the cutting edge of the razor that is
5858 intended to:
5959 (1) prevent the razor from cutting too deeply; and
6060 (2) reduce the risk and incidence of accidental cuts.
6161 SECTION 2. This Act takes effect September 1, 2013.
