For the purposes of determining whether a student is allowed an exemption or postponement of an assessment because the student recently enrolled in a school in the United States and is of limited English proficiency, the bill would prohibit the consideration of a school year if the student is enrolled in a school in the United States for a period of less than 60 consecutive days during a year. The bill would prohibit the Commissioner of Education from lowering a performance rating based on unsatisfactory performance on an assessment instrument of a student who has been enrolled in the United States for a period of two years or less if the student is of limited English proficiency. These provisions would not apply if the LEP student was administered an assessment instrument in their native language Based on information provided by the Texas Education Agency, any costs related to implementing the provisions of the bill are not anticipated to be significant.
