77 relating to county participation in a program for improvement of
88 collection of court costs, fees, and fines imposed in criminal
99 cases.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 103.0033, Code of Criminal Procedure, is
1212 amended by amending Subsection (c) and adding Subsection (h-1) to
1313 read as follows:
1414 (c) Unless granted a waiver under Subsection (h)(2) or (h-1)
1515 [(h)], each county and municipality shall develop and implement a
1616 program that complies with the prioritized implementation schedule
1717 under Subsection (h)(1) [(h)]. A county program must include
1818 district, county, and justice courts.
1919 (h-1) The office shall grant a waiver to a county that:
2020 (1) contains within its borders a correctional
2121 facility operated by or under contract with the Texas Department of
2222 Criminal Justice; and
2323 (2) has a population of 50,000 or more only because the
2424 inmate population of all correctional facilities described by
2525 Subdivision (1) is included in that population.
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2013.
