8 | 8 | | collection of court costs, fees, and fines imposed in criminal |
---|
9 | 9 | | cases. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Article 103.0033, Code of Criminal Procedure, is |
---|
12 | 12 | | amended by amending Subsection (c) and adding Subsection (h-1) to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | (c) Unless granted a waiver under Subsection (h)(2) or (h-1) |
---|
15 | 15 | | [(h)], each county and municipality shall develop and implement a |
---|
16 | 16 | | program that complies with the prioritized implementation schedule |
---|
17 | 17 | | under Subsection (h)(1) [(h)]. A county program must include |
---|
18 | 18 | | district, county, and justice courts. |
---|
19 | 19 | | (h-1) The office shall grant a waiver to a county that: |
---|
20 | 20 | | (1) contains within its borders a correctional |
---|
21 | 21 | | facility operated by or under contract with the Texas Department of |
---|
22 | 22 | | Criminal Justice; and |
---|
23 | 23 | | (2) has a population of 50,000 or more only because the |
---|
24 | 24 | | inmate population of all correctional facilities described by |
---|
25 | 25 | | Subdivision (1) is included in that population. |
---|
26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
---|
27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
---|
28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
---|
30 | 30 | | Act takes effect September 1, 2013. |
