77 relating to restricting access to records of children convicted of
88 or receiving deferred disposition for certain fine-only
99 misdemeanors.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 44.2811, Code of Criminal Procedure, is
1212 amended to read as follows:
1313 Art. 44.2811. RECORDS RELATING TO CHILDREN CONVICTED OF OR
1414 RECEIVING DEFERRED DISPOSITION FOR FINE-ONLY MISDEMEANORS.
1515 (a) This article applies only to a misdemeanor offense punishable
1616 by fine only, other than a traffic offense.
1717 (b) All records and files and information stored by
1818 electronic means or otherwise, from which a record or file could be
1919 generated, relating to a child who is convicted of and has satisfied
2020 the judgment for or who has received a dismissal after deferral of
2121 disposition for an [a fine-only misdemeanor] offense described by
2222 Subsection (a) [other than a traffic offense] are confidential and
2323 may not be disclosed to the public except as provided under Article
2424 45.0217(b). [All records and files and information stored by
2525 electronic means or otherwise, from which a record or file could be
2626 generated, relating to a child whose conviction for a fine-only
2727 misdemeanor other than a traffic offense is affirmed are
2828 confidential upon satisfaction of the judgment and may not be
2929 disclosed to the public except as provided under Article
3030 45.0217(b).]
3131 SECTION 2. Article 45.0217, Code of Criminal Procedure, is
3232 amended to read as follows:
3333 Art. 45.0217. CONFIDENTIAL RECORDS RELATED TO THE
3434 CONVICTION OF OR DEFERRAL OF DISPOSITION FOR A CHILD. (a) This
3535 article applies only to a misdemeanor offense punishable by fine
3636 only, other than a traffic offense.
3737 (a-1) Except as provided by Article 15.27 and Subsection
3838 (b), all records and files, including those held by law
3939 enforcement, and information stored by electronic means or
4040 otherwise, from which a record or file could be generated, relating
4141 to a child who is convicted of and has satisfied the judgment for or
4242 who has received a dismissal after deferral of disposition for an [a
4343 fine-only misdemeanor] offense described by Subsection (a) [other
4444 than a traffic offense] are confidential and may not be disclosed to
4545 the public.
4646 (b) Information subject to Subsection (a-1) [(a)] may be
4747 open to inspection only by:
4848 (1) judges or court staff;
4949 (2) a criminal justice agency for a criminal justice
5050 purpose, as those terms are defined by Section 411.082, Government
5151 Code;
5252 (3) the Department of Public Safety;
5353 (4) an attorney for a party to the proceeding;
5454 (5) the child defendant; or
5555 (6) the defendant's parent, guardian, or managing
5656 conservator.
5757 SECTION 3. Section 58.00711, Family Code, is amended to
5858 read as follows:
5959 Sec. 58.00711. RECORDS RELATING TO CHILDREN CONVICTED OF OR
6060 RECEIVING DEFERRED DISPOSITION FOR FINE-ONLY MISDEMEANORS.
6161 (a) This section applies only to a misdemeanor offense punishable
6262 by fine only, other than a traffic offense.
6363 (b) Except as provided by Article 45.0217(b), Code of
6464 Criminal Procedure, all records and files and information stored by
6565 electronic means or otherwise, from which a record or file could be
6666 generated, relating to a child who is convicted of and has satisfied
6767 the judgment for or who has received a dismissal after deferral of
6868 disposition for an [a fine-only misdemeanor] offense described by
6969 Subsection (a) [other than a traffic offense] are confidential and
7070 may not be disclosed to the public.
7171 SECTION 4. Articles 44.2811 and 45.0217, Code of Criminal
7272 Procedure, and Section 58.00711, Family Code, as amended by this
7373 Act, apply to the disclosure of a record or file on or after the
7474 effective date of this Act regardless of whether the offense that is
7575 the subject of the record or file was committed before, on, or after
7676 the effective date of this Act.
7777 SECTION 5. This Act takes effect September 1, 2013.
