14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 15 | | SECTION 1. Subchapter C, Chapter 108, Alcoholic Beverage |
---|
16 | 16 | | Code, is amended by adding Section 108.82 to read as follows: |
---|
17 | 17 | | Sec. 108.82. ALCOHOLIC BEVERAGE CONSUMPTION IN CERTAIN |
---|
18 | 18 | | PUBLIC ENTERTAINMENT FACILITIES. (a) This section applies only |
---|
19 | 19 | | with respect to a public entertainment facility: |
---|
20 | 20 | | (1) that is a stadium: |
---|
21 | 21 | | (A) located in a county with a population of more |
---|
22 | 22 | | than 1.6 million; |
---|
23 | 23 | | (B) constructed not later than 1994; and |
---|
24 | 24 | | (C) with a seating capacity of at least 45,000; |
---|
25 | 25 | | and |
---|
26 | 26 | | (2) for which all alcoholic beverage permits and |
---|
27 | 27 | | licenses are held by a single independent concessionaire. |
---|
28 | 28 | | (b) Notwithstanding Section 28.10, the independent |
---|
29 | 29 | | concessionaire for a public entertainment facility described by |
---|
30 | 30 | | Subsection (a) may allow a patron who possesses an alcoholic |
---|
31 | 31 | | beverage to enter or leave a licensed or permitted premises within |
---|
32 | 32 | | the facility if the alcoholic beverage: |
---|
33 | 33 | | (1) is in an open container, as defined by Section |
---|
34 | 34 | | 49.031, Penal Code; |
---|
35 | 35 | | (2) appears to be possessed for present consumption; |
---|
36 | 36 | | (3) remains within the confines of the facility, |
---|
37 | 37 | | excluding a parking lot; and |
---|
38 | 38 | | (4) was purchased legally at a licensed or permitted |
---|
39 | 39 | | premises within the facility. |
---|
40 | 40 | | SECTION 2. This Act takes effect September 1, 2013. |
