77 relating to foster care placement decisions made by the Department
88 of Family and Protective Services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (e), Section 264.107, Family Code, is
1111 amended to read as follows:
1212 (e) In making placement decisions, the department shall:
1313 (1) except when making an emergency placement that
1414 does not allow time for the required consultations, consult with
1515 the child's caseworker, [and the child's] attorney ad litem, and
1616 guardian ad litem and with any[, or] court-appointed volunteer
1717 advocate for the child [when possible]; and
1818 (2) use clinical protocols to match a child to the most
1919 appropriate placement resource.
2020 SECTION 2. Subsection (e), Section 264.107, Family Code, as
2121 amended by this Act, applies only to a foster care placement
2222 decision made by the Department of Family and Protective Services
2323 on or after the effective date of this Act.
2424 SECTION 3. This Act takes effect September 1, 2013.
