9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subsection (e), Section 264.107, Family Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (e) In making placement decisions, the department shall: | |
13 | 13 | (1) except when making an emergency placement that | |
14 | 14 | does not allow time for the required consultations, consult with | |
15 | 15 | the child's caseworker, [and the child's] attorney ad litem, and | |
16 | 16 | guardian ad litem and with any[, or] court-appointed volunteer | |
17 | 17 | advocate for the child [when possible]; and | |
18 | 18 | (2) use clinical protocols to match a child to the most | |
19 | 19 | appropriate placement resource. | |
20 | 20 | SECTION 2. Subsection (e), Section 264.107, Family Code, as | |
21 | 21 | amended by this Act, applies only to a foster care placement | |
22 | 22 | decision made by the Department of Family and Protective Services | |
23 | 23 | on or after the effective date of this Act. | |
24 | 24 | SECTION 3. This Act takes effect September 1, 2013. |
