9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 42.056, Human Resources Code, is amended | |
11 | 11 | by adding Subsection (a-1) to read as follows: | |
12 | 12 | (a-1) Notwithstanding Subsection (a), the director, owner, | |
13 | 13 | or operator of a residential child-care facility is not required to | |
14 | 14 | submit to the department the information required under that | |
15 | 15 | subsection for use in conducting a background and criminal history | |
16 | 16 | check on a parent or other relative of a child who is a client in | |
17 | 17 | care at the facility if: | |
18 | 18 | (1) the department has on file for the parent or | |
19 | 19 | relative a background and criminal history check; and | |
20 | 20 | (2) the background and criminal history check was | |
21 | 21 | conducted within the two-year period preceding the date the parent | |
22 | 22 | or relative visits the client at the facility. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2013. |
