| 7 | 7 | | relating to payment of tuition to attend public schools for |
|---|
| 8 | 8 | | students holding certain United States student visas. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 25, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 25.0031 to read as follows: |
|---|
| 12 | 12 | | Sec. 25.0031. TUITION FOR STUDENTS HOLDING CERTAIN STUDENT |
|---|
| 13 | 13 | | VISAS. (a) Notwithstanding any other provision of this code, if a |
|---|
| 14 | 14 | | student is required, as a condition of obtaining or holding the |
|---|
| 15 | 15 | | appropriate United States student visa, to pay tuition to the |
|---|
| 16 | 16 | | school district or open-enrollment charter school that the student |
|---|
| 17 | 17 | | attends to cover the cost of the student's education provided by the |
|---|
| 18 | 18 | | district or charter school, the district or charter school shall |
|---|
| 19 | 19 | | accept tuition for the student in an amount equal to the full |
|---|
| 20 | 20 | | unsubsidized per capita cost of providing the student's education |
|---|
| 21 | 21 | | for the period of the student's attendance at school in the district |
|---|
| 22 | 22 | | or at the charter school. |
|---|
| 23 | 23 | | (b) The commissioner shall, for purposes of Subsection (a), |
|---|
| 24 | 24 | | develop guidelines for determining the amount of the full |
|---|
| 25 | 25 | | unsubsidized per capita cost of providing a student's education. A |
|---|
| 26 | 26 | | school district or open-enrollment charter school may not accept |
|---|
| 27 | 27 | | tuition in an amount greater than the amount computed under the |
|---|
| 28 | 28 | | commissioner's guidelines unless the commissioner approves a |
|---|
| 29 | 29 | | greater amount as a more accurate reflection of the cost of |
|---|
| 30 | 30 | | education to be provided by the district or charter school. |
|---|
| 31 | 31 | | (c) Notwithstanding any other provision of this code, the |
|---|
| 32 | 32 | | attendance of a student for whom a school district or |
|---|
| 33 | 33 | | open-enrollment charter school accepts tuition under this section |
|---|
| 34 | 34 | | is not counted for purposes of allocating state funds to the |
|---|
| 35 | 35 | | district or charter school. |
|---|
| 36 | 36 | | SECTION 2. This Act applies beginning with the 2013-2014 |
|---|
| 37 | 37 | | school year. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2013. |
|---|
