77 relating to payment of tuition to attend public schools for
88 students holding certain United States student visas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 25, Education Code, is
1111 amended by adding Section 25.0031 to read as follows:
1212 Sec. 25.0031. TUITION FOR STUDENTS HOLDING CERTAIN STUDENT
1313 VISAS. (a) Notwithstanding any other provision of this code, if a
1414 student is required, as a condition of obtaining or holding the
1515 appropriate United States student visa, to pay tuition to the
1616 school district or open-enrollment charter school that the student
1717 attends to cover the cost of the student's education provided by the
1818 district or charter school, the district or charter school shall
1919 accept tuition for the student in an amount equal to the full
2020 unsubsidized per capita cost of providing the student's education
2121 for the period of the student's attendance at school in the district
2222 or at the charter school.
2323 (b) The commissioner shall, for purposes of Subsection (a),
2424 develop guidelines for determining the amount of the full
2525 unsubsidized per capita cost of providing a student's education. A
2626 school district or open-enrollment charter school may not accept
2727 tuition in an amount greater than the amount computed under the
2828 commissioner's guidelines unless the commissioner approves a
2929 greater amount as a more accurate reflection of the cost of
3030 education to be provided by the district or charter school.
3131 (c) Notwithstanding any other provision of this code, the
3232 attendance of a student for whom a school district or
3333 open-enrollment charter school accepts tuition under this section
3434 is not counted for purposes of allocating state funds to the
3535 district or charter school.
3636 SECTION 2. This Act applies beginning with the 2013-2014
3737 school year.
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2013.
