99 AN ACT
1010 relating to the creation of the Montgomery County Municipal Utility
1111 District No. 136; granting a limited power of eminent domain;
1212 providing authority to issue bonds and impose a tax.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1515 Code, is amended by adding Chapter 8433 to read as follows:
1616 CHAPTER 8433. MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT NO. 136
1717 SUBCHAPTER A. GENERAL PROVISIONS
1818 Sec. 8433.001. DEFINITIONS. In this chapter:
1919 (1) "Board" means the district's board of directors.
2020 (2) "Commission" means the Texas Commission on
2121 Environmental Quality.
2222 (3) "Director" means a board member.
2323 (4) "District" means the Montgomery County Municipal
2424 Utility District No. 136.
2525 Sec. 8433.002. NATURE OF DISTRICT. The district is a
2626 municipal utility district created under Section 59, Article XVI,
2727 Texas Constitution.
2828 Sec. 8433.003. CONFIRMATION AND DIRECTORS' ELECTION
2929 REQUIRED. The temporary directors shall hold an election to
3030 confirm the creation of the district and to elect five permanent
3131 directors as provided by Section 49.102, Water Code.
3232 Sec. 8433.004. CONSENT OF MUNICIPALITY REQUIRED. The
3333 temporary directors may not hold an election under Section 8433.003
3434 until each municipality in whose corporate limits or
3535 extraterritorial jurisdiction the district is located has
3636 consented by ordinance or resolution to the creation of the
3737 district and to the inclusion of land in the district.
3838 Sec. 8433.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3939 (a) The district is created to serve a public purpose and benefit.
4040 (b) The district is created to accomplish the purposes of:
4141 (1) a municipal utility district as provided by
4242 general law and Section 59, Article XVI, Texas Constitution; and
4343 (2) Section 52, Article III, Texas Constitution, that
4444 relate to the construction, acquisition, or improvement of
4545 macadamized, graveled, or paved roads described by Section 54.234,
4646 Water Code, or improvements, including storm drainage, in aid of
4747 those roads.
4848 Sec. 8433.006. INITIAL DISTRICT TERRITORY. (a) The
4949 district is initially composed of the territory described by
5050 Section 2 of the Act enacting this chapter.
5151 (b) The boundaries and field notes contained in Section 2 of
5252 the Act enacting this chapter form a closure. A mistake made in the
5353 field notes or in copying the field notes in the legislative process
5454 does not affect the district's:
5555 (1) organization, existence, or validity;
5656 (2) right to issue any type of bond for the purposes
5757 for which the district is created or to pay the principal of and
5858 interest on a bond;
5959 (3) right to impose a tax; or
6060 (4) legality or operation.
6161 SUBCHAPTER B. BOARD OF DIRECTORS
6262 Sec. 8433.051. GOVERNING BODY; TERMS. (a) The district is
6363 governed by a board of five elected directors.
6464 (b) Except as provided by Section 8433.052, directors serve
6565 staggered four-year terms.
6666 Sec. 8433.052. TEMPORARY DIRECTORS. (a) On or after the
6767 effective date of the Act enacting this chapter, the owner or owners
6868 of a majority of the assessed value of the real property in the
6969 district may submit a petition to the commission requesting that
7070 the commission appoint as temporary directors the five persons
7171 named in the petition. The commission shall appoint as temporary
7272 directors the five persons named in the petition.
7373 (b) Temporary directors serve until the earlier of:
7474 (1) the date permanent directors are elected under
7575 Section 8433.003; or
7676 (2) the fourth anniversary of the effective date of
7777 the Act enacting this chapter.
7878 (c) If permanent directors have not been elected under
7979 Section 8433.003 and the terms of the temporary directors have
8080 expired, successor temporary directors shall be appointed or
8181 reappointed as provided by Subsection (d) to serve terms that
8282 expire on the earlier of:
8383 (1) the date permanent directors are elected under
8484 Section 8433.003; or
8585 (2) the fourth anniversary of the date of the
8686 appointment or reappointment.
8787 (d) If Subsection (c) applies, the owner or owners of a
8888 majority of the assessed value of the real property in the district
8989 may submit a petition to the commission requesting that the
9090 commission appoint as successor temporary directors the five
9191 persons named in the petition. The commission shall appoint as
9292 successor temporary directors the five persons named in the
9393 petition.
9494 SUBCHAPTER C. POWERS AND DUTIES
9595 Sec. 8433.101. GENERAL POWERS AND DUTIES. The district has
9696 the powers and duties necessary to accomplish the purposes for
9797 which the district is created.
9898 Sec. 8433.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9999 DUTIES. The district has the powers and duties provided by the
100100 general law of this state, including Chapters 49 and 54, Water Code,
101101 applicable to municipal utility districts created under Section 59,
102102 Article XVI, Texas Constitution.
103103 Sec. 8433.103. AUTHORITY FOR ROAD PROJECTS. (a) Under
104104 Section 52, Article III, Texas Constitution, the district may
105105 design, acquire, construct, finance, issue bonds for, improve, and
106106 convey to this state, a county, or a municipality for operation and
107107 maintenance macadamized, graveled, or paved roads described by
108108 Section 54.234, Water Code, or improvements, including storm
109109 drainage, in aid of those roads.
110110 (b) The district may exercise the powers provided by this
111111 section without submitting a petition to or obtaining approval from
112112 the commission as required by Section 54.234, Water Code.
113113 Sec. 8433.104. APPROVAL OF ROAD PROJECT. (a) The district
114114 may not undertake a road project authorized by Section 8433.103
115115 unless:
116116 (1) each municipality or county that will operate and
117117 maintain the road has approved the plans and specifications of the
118118 road project, if a municipality or county will operate and maintain
119119 the road; or
120120 (2) the Texas Transportation Commission has approved
121121 the plans and specifications of the road project, if the state will
122122 operate and maintain the road.
123123 (b) Except as provided by Subsection (a), the district is
124124 not required to obtain approval from the Texas Transportation
125125 Commission to design, acquire, construct, finance, issue bonds for,
126126 improve, or convey a road project.
127127 Sec. 8433.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
128128 OR RESOLUTION. The district shall comply with all applicable
129129 requirements of any ordinance or resolution that is adopted under
130130 Section 54.016 or 54.0165, Water Code, and that consents to the
131131 creation of the district or to the inclusion of land in the
132132 district.
133133 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
134134 Sec. 8433.151. ELECTIONS REGARDING TAXES OR BONDS.
135135 (a) The district may issue, without an election, bonds and other
136136 obligations secured by:
137137 (1) revenue other than ad valorem taxes; or
138138 (2) contract payments described by Section 8433.153.
139139 (b) The district must hold an election in the manner
140140 provided by Chapters 49 and 54, Water Code, to obtain voter approval
141141 before the district may impose an ad valorem tax or issue bonds
142142 payable from ad valorem taxes.
143143 (c) The district may not issue bonds payable from ad valorem
144144 taxes to finance a road project unless the issuance is approved by a
145145 vote of a two-thirds majority of the district voters voting at an
146146 election held for that purpose.
147147 Sec. 8433.152. OPERATION AND MAINTENANCE TAX. (a) If
148148 authorized at an election held under Section 8433.151, the district
149149 may impose an operation and maintenance tax on taxable property in
150150 the district in accordance with Section 49.107, Water Code.
151151 (b) The board shall determine the tax rate. The rate may not
152152 exceed the rate approved at the election.
153153 Sec. 8433.153. CONTRACT TAXES. (a) In accordance with
154154 Section 49.108, Water Code, the district may impose a tax other than
155155 an operation and maintenance tax and use the revenue derived from
156156 the tax to make payments under a contract after the provisions of
157157 the contract have been approved by a majority of the district voters
158158 voting at an election held for that purpose.
159159 (b) A contract approved by the district voters may contain a
160160 provision stating that the contract may be modified or amended by
161161 the board without further voter approval.
162162 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
163163 Sec. 8433.201. AUTHORITY TO ISSUE BONDS AND OTHER
164164 OBLIGATIONS. The district may issue bonds or other obligations
165165 payable wholly or partly from ad valorem taxes, impact fees,
166166 revenue, contract payments, grants, or other district money, or any
167167 combination of those sources, to pay for any authorized district
168168 purpose.
169169 Sec. 8433.202. TAXES FOR BONDS. At the time the district
170170 issues bonds payable wholly or partly from ad valorem taxes, the
171171 board shall provide for the annual imposition of a continuing
172172 direct ad valorem tax, without limit as to rate or amount, while all
173173 or part of the bonds are outstanding as required and in the manner
174174 provided by Sections 54.601 and 54.602, Water Code.
175175 Sec. 8433.203. BONDS FOR ROAD PROJECTS. At the time of
176176 issuance, the total principal amount of bonds or other obligations
177177 issued or incurred to finance road projects and payable from ad
178178 valorem taxes may not exceed one-fourth of the assessed value of the
179179 real property in the district.
180180 SECTION 2. The Montgomery County Municipal Utility District
181181 No. 136 initially includes all the territory contained in the
182182 following area:
183183 Being a 302.00 acre (13,155,064 square feet) parcel situated
184184 in the John M. Smith Survey, Abstract 533 and the John Foster
185185 Survey, Abstract 205, Montgomery County, Texas, being all of a
186186 called 292.0 acre tract conveyed to Lakes At Mill Creek, L.P. by
187187 General Warranty Deed recorded under Clerk's File No. 2006-092982
188188 of the Official Public Records of Real Property, Montgomery County,
189189 Texas, all of a called 10.0088 acre tract conveyed to Lakes at Mill
190190 Creek, L.P. by Deed recorded under Clerk's File No. 2009-010587 of
191191 the Official Public Records of Real Property, Montgomery County,
192192 Texas, containing Unrestricted Reserve "A", Unrestricted Reserve
193193 "B" and Unrestricted Reserve "C" of Silverado Ranches according to
194194 the map or plat recorded under Cabinet G, Sheet 135 of the Map
195195 Records of Montgomery County, Texas, said 302.00 acre parcel more
196196 particularly described by metes and bounds as follows with all
197197 bearings referenced to the Texas State Plane Coordinate System,
198198 Central Zone;
199199 BEGINNING, at a concrete monument found for the most easterly
200200 corner of a called 2,420.0166 acre tract conveyed to Terra
201201 Investments, L.P. by Special Warranty Deed recorded under Clerk's
202202 File No. 2004-023496 of the Official Public Records of Real
203203 Property, Montgomery County, Texas, for an interior corner of said
204204 292.0 acre tract, and the herein described parcel, from which a
205205 1-inch iron pipe found bears South 66°05'10" East, 23.42 feet;
206206 THENCE, North 47°33'32" West, 2965.11 feet along the

491491 SECTION 3. (a) The legal notice of the intention to
492492 introduce this Act, setting forth the general substance of this
493493 Act, has been published as provided by law, and the notice and a
494494 copy of this Act have been furnished to all persons, agencies,
495495 officials, or entities to which they are required to be furnished
496496 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
497497 Government Code.
498498 (b) The governor, one of the required recipients, has
499499 submitted the notice and Act to the Texas Commission on
500500 Environmental Quality.
501501 (c) The Texas Commission on Environmental Quality has filed
502502 its recommendations relating to this Act with the governor, the
503503 lieutenant governor, and the speaker of the house of
504504 representatives within the required time.
505505 (d) All requirements of the constitution and laws of this
506506 state and the rules and procedures of the legislature with respect
507507 to the notice, introduction, and passage of this Act are fulfilled
508508 and accomplished.
509509 SECTION 4. (a) If this Act does not receive a two-thirds
510510 vote of all the members elected to each house, Subchapter C, Chapter
511511 8433, Special District Local Laws Code, as added by Section 1 of
512512 this Act, is amended by adding Section 8433.106 to read as follows:
513513 Sec. 8433.106. NO EMINENT DOMAIN POWER. The district may
514514 not exercise the power of eminent domain.
515515 (b) This section is not intended to be an expression of a
516516 legislative interpretation of the requirements of Subsection (c),
517517 Section 17, Article I, Texas Constitution.
518518 SECTION 5. This Act takes effect immediately if it receives
519519 a vote of two-thirds of all the members elected to each house, as
520520 provided by Section 39, Article III, Texas Constitution. If this
521521 Act does not receive the vote necessary for immediate effect, this
522522 Act takes effect September 1, 2013.
