| 7 | 7 | | relating to all-terrain vehicles and recreational off-highway |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subdivisions (1) and (37), Section 502.001, |
|---|
| 11 | 11 | | Transportation Code, are amended to read as follows: |
|---|
| 12 | 12 | | (1) "All-terrain vehicle" means a motor vehicle that |
|---|
| 13 | 13 | | is: |
|---|
| 14 | 14 | | (A) equipped with a seat or seats [saddle] for |
|---|
| 15 | 15 | | the use of: |
|---|
| 16 | 16 | | (i) the rider; and |
|---|
| 17 | 17 | | (ii) a passenger, if the motor vehicle is |
|---|
| 18 | 18 | | designed by the manufacturer to transport a passenger; |
|---|
| 19 | 19 | | (B) designed to propel itself with three or more |
|---|
| 20 | 20 | | tires in contact with the ground; |
|---|
| 21 | 21 | | (C) designed by the manufacturer for off-highway |
|---|
| 22 | 22 | | use; [and] |
|---|
| 23 | 23 | | (D) not designed by the manufacturer primarily |
|---|
| 24 | 24 | | for farming or lawn care; and |
|---|
| 25 | 25 | | (E) not more than 50 inches wide. |
|---|
| 26 | 26 | | (37) "Recreational off-highway vehicle" means a motor |
|---|
| 27 | 27 | | vehicle that is: |
|---|
| 28 | 28 | | (A) equipped with a [non-straddle] seat or seats |
|---|
| 29 | 29 | | for the use of: |
|---|
| 30 | 30 | | (i) the rider; and |
|---|
| 31 | 31 | | (ii) a passenger or passengers, if the |
|---|
| 32 | 32 | | vehicle is designed by the manufacturer to transport a passenger or |
|---|
| 33 | 33 | | passengers; |
|---|
| 34 | 34 | | (B) designed to propel itself with four or more |
|---|
| 35 | 35 | | tires in contact with the ground; |
|---|
| 36 | 36 | | (C) designed by the manufacturer for off-highway |
|---|
| 37 | 37 | | use by the operator only; and |
|---|
| 38 | 38 | | (D) not designed by the manufacturer primarily |
|---|
| 39 | 39 | | for farming or lawn care. |

| 40 | 40 | | SECTION 2. Subdivision (1), Section 663.001, |

| 41 | 41 | | Transportation Code, is amended to read as follows: |
