77 relating to all-terrain vehicles and recreational off-highway
88 vehicles.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subdivisions (1) and (37), Section 502.001,
1111 Transportation Code, are amended to read as follows:
1212 (1) "All-terrain vehicle" means a motor vehicle that
1313 is:
1414 (A) equipped with a seat or seats [saddle] for
1515 the use of:
1616 (i) the rider; and
1717 (ii) a passenger, if the motor vehicle is
1818 designed by the manufacturer to transport a passenger;
1919 (B) designed to propel itself with three or more
2020 tires in contact with the ground;
2121 (C) designed by the manufacturer for off-highway
2222 use; [and]
2323 (D) not designed by the manufacturer primarily
2424 for farming or lawn care; and
2525 (E) not more than 50 inches wide.
2626 (37) "Recreational off-highway vehicle" means a motor
2727 vehicle that is:
2828 (A) equipped with a [non-straddle] seat or seats
2929 for the use of:
3030 (i) the rider; and
3131 (ii) a passenger or passengers, if the
3232 vehicle is designed by the manufacturer to transport a passenger or
3333 passengers;
3434 (B) designed to propel itself with four or more
3535 tires in contact with the ground;
3636 (C) designed by the manufacturer for off-highway
3737 use by the operator only; and
3838 (D) not designed by the manufacturer primarily
3939 for farming or lawn care.
4040 SECTION 2. Subdivision (1), Section 663.001,
4141 Transportation Code, is amended to read as follows:
4242 (1) "All-terrain vehicle" means a motor vehicle that
4343 is:
4444 (A) equipped with a seat or seats [saddle] for
4545 the use of:
4646 (i) the rider; and
4747 (ii) a passenger, if the motor vehicle is
4848 designed by the manufacturer to transport a passenger;
4949 (B) designed to propel itself with three or four
5050 tires in contact with the ground;
5151 (C) designed by the manufacturer for off-highway
5252 use by the operator only; [and]
5353 (D) not designed by the manufacturer for farming
5454 or lawn care; and
5555 (E) not more than 50 inches wide.
5656 SECTION 3. This Act takes effect September 1, 2013.
