12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Chapter 33, Education Code, is amended by adding |
---|
14 | 14 | | Subchapter G to read as follows: |
---|
15 | 15 | | SUBCHAPTER G. EXPANDED LEARNING OPPORTUNITIES COUNCIL |
---|
16 | 16 | | Sec. 33.251. DEFINITION. In this chapter, "council" means |
---|
17 | 17 | | the Expanded Learning Opportunities Council. |
---|
18 | 18 | | Sec. 33.252. EXPANDED LEARNING OPPORTUNITIES. (a) |
---|
19 | 19 | | Expanded learning opportunities may be provided during: |
---|
20 | 20 | | (1) an extended school day; |
---|
21 | 21 | | (2) an extended school year; or |
---|
22 | 22 | | (3) structured learning programs outside of the |
---|
23 | 23 | | regular school day, including before- and after-school programs and |
---|
24 | 24 | | summer programs. |
---|
25 | 25 | | (b) Expanded learning opportunities may be provided by |
---|
26 | 26 | | offering: |
---|
27 | 27 | | (1) rigorous coursework; |
---|
28 | 28 | | (2) mentoring; |
---|
29 | 29 | | (3) tutoring; |
---|
30 | 30 | | (4) physical activity; |
---|
31 | 31 | | (5) academic support; or |
---|
32 | 32 | | (6) educational enrichment in one or more subjects, |
---|
33 | 33 | | including fine arts, civic engagement, science, technology, |
---|
34 | 34 | | engineering, and mathematics. |
---|
35 | 35 | | Sec. 33.253. ESTABLISHMENT; PURPOSES. (a) The Expanded |
---|
36 | 36 | | Learning Opportunities Council is established to: |
---|
37 | 37 | | (1) study issues concerning expanded learning |
---|
38 | 38 | | opportunities for this state's public school students, including: |
---|
39 | 39 | | (A) issues related to creating safe places for |
---|
40 | 40 | | children outside of the regular school day, improving the academic |
---|
41 | 41 | | success of students who participate in expanded learning |
---|
42 | 42 | | opportunities programs, and assisting working families; and |
---|
43 | 43 | | (B) other issues prescribed under Section |
---|
44 | 44 | | 33.258; and |
---|
45 | 45 | | (2) make recommendations as provided by Section 33.259 |
---|
46 | 46 | | to address issues studied under this subchapter. |
---|
47 | 47 | | (b) In conducting studies under this subchapter, the |
---|
48 | 48 | | council shall focus on innovative, hands-on learning approaches |
---|
49 | 49 | | that complement rather than replicate the regular school |
---|
50 | 50 | | curriculum. |
---|
51 | 51 | | Sec. 33.254. SUNSET PROVISION. The council is subject to |
---|
52 | 52 | | Chapter 325, Government Code (Texas Sunset Act). Unless continued |
---|
53 | 53 | | in existence as provided by that chapter, the council is abolished |
---|
54 | 54 | | and this subchapter expires September 1, 2017. |
---|
55 | 55 | | Sec. 33.255. COMPOSITION. The council is composed of 13 |
---|
56 | 56 | | members appointed by the commissioner as follows: |
---|
57 | 57 | | (1) two members of the public, including one |
---|
58 | 58 | | representing the business community and one parent of a public |
---|
59 | 59 | | school student participating in an expanded learning opportunities |
---|
60 | 60 | | program in this state; |
---|
61 | 61 | | (2) two members who are involved in research-based |
---|
62 | 62 | | expanded learning opportunities efforts in this state so that at |
---|
63 | 63 | | least one is involved in efforts to extend the school day or school |
---|
64 | 64 | | year and at least one is involved in efforts to provide out of |
---|
65 | 65 | | school time before or after the regular school day or during the |
---|
66 | 66 | | period in which school is recessed for the summer; |
---|
67 | 67 | | (3) one member representing law enforcement; |
---|
68 | 68 | | (4) one member representing the agency; |
---|
69 | 69 | | (5) one member who is an educator, other than a |
---|
70 | 70 | | superintendent, at the elementary school level; |
---|
71 | 71 | | (6) one member who is an educator, other than a |
---|
72 | 72 | | superintendent, at the middle or junior high school level; |
---|
73 | 73 | | (7) one member who is an educator, other than a |
---|
74 | 74 | | superintendent, at the high school level; |
---|
75 | 75 | | (8) one member who is a public school superintendent; |
---|
76 | 76 | | (9) one member representing a foundation that invests |
---|
77 | 77 | | in expanded learning opportunities; |
---|
78 | 78 | | (10) one member representing a nonprofit organization |
---|
79 | 79 | | that provides programs concerning good nutrition and prevention of |
---|
80 | 80 | | or intervention to address childhood obesity; and |
---|
81 | 81 | | (11) one member who is a provider representing summer |
---|
82 | 82 | | camps. |
---|
83 | 83 | | Sec. 33.256. MEETINGS. (a) The council shall meet in |
---|
84 | 84 | | person at least three times each year and may hold additional |
---|
85 | 85 | | meetings by conference call if necessary. |
---|
86 | 86 | | (b) Section 551.125, Government Code, applies to a meeting |
---|
87 | 87 | | held by conference call under this section, except that Section |
---|
88 | 88 | | 551.125(b), Government Code, does not apply. |
---|
89 | 89 | | Sec. 33.257. COMPENSATION. A member of the council may not |
---|
90 | 90 | | receive compensation for service on the council. |
---|
91 | 91 | | Sec. 33.258. POWERS AND DUTIES. (a) The council shall: |
---|
92 | 92 | | (1) study issues related to expanded learning |
---|
93 | 93 | | opportunities for public school students; |
---|
94 | 94 | | (2) study current research and best practices related |
---|
95 | 95 | | to meaningful expanded learning opportunities; |
---|
96 | 96 | | (3) analyze the availability of and unmet needs for |
---|
97 | 97 | | state and local programs for expanded learning opportunities for |
---|
98 | 98 | | public school students; |
---|
99 | 99 | | (4) analyze opportunities to create incentives for |
---|
100 | 100 | | businesses to support expanded learning opportunities programs for |
---|
101 | 101 | | public school students; |
---|
102 | 102 | | (5) analyze opportunities to maximize charitable |
---|
103 | 103 | | support for public and private partnerships for expanded learning |
---|
104 | 104 | | opportunities programs for public school students; |
---|
105 | 105 | | (6) analyze opportunities to promote science, |
---|
106 | 106 | | technology, engineering, and mathematics in expanded learning |
---|
107 | 107 | | opportunities programs for public school students; |
---|
108 | 108 | | (7) study the future workforce needs of this state's |
---|
109 | 109 | | businesses and other employers; and |
---|
110 | 110 | | (8) perform other duties consistent with this |
---|
111 | 111 | | subchapter. |
---|
112 | 112 | | (b) In carrying out its powers and duties under this |
---|
113 | 113 | | section, the council may request reports and other information |
---|
114 | 114 | | relating to expanded learning opportunities and students in |
---|
115 | 115 | | expanded learning opportunities programs from the Texas Education |
---|
116 | 116 | | Agency and any other state agency. |
---|
117 | 117 | | Sec. 33.259. STATEWIDE EXPANDED LEARNING OPPORTUNITIES |
---|
118 | 118 | | PLAN; REPORT. (a) The council shall develop a comprehensive |
---|
119 | 119 | | statewide action plan for the improvement of expanded learning |
---|
120 | 120 | | opportunities for public school students in this state, including a |
---|
121 | 121 | | timeline for implementation of the plan. |
---|
122 | 122 | | (b) The council shall submit to both houses of the |
---|
123 | 123 | | legislature, the governor, and the agency on or before November 1 of |
---|
124 | 124 | | each even-numbered year a written report concerning: |
---|
125 | 125 | | (1) the status of the development or implementation of |
---|
126 | 126 | | the council's statewide action plan, as applicable; |
---|
127 | 127 | | (2) any action taken to further development or |
---|
128 | 128 | | implementation of the plan; |
---|
129 | 129 | | (3) any area that needs improvement in implementing |
---|
130 | 130 | | the plan; |
---|
131 | 131 | | (4) any recommended change to the plan; and |
---|
132 | 132 | | (5) programs and services that address expanded |
---|
133 | 133 | | learning opportunities outside of the regular school day. |
---|
134 | 134 | | Sec. 33.260. GIFTS, GRANTS, AND DONATIONS. The agency may |
---|
135 | 135 | | accept on behalf of the council a gift, grant, or donation from any |
---|
136 | 136 | | source to carry out the purposes of this subchapter. |
---|
137 | 137 | | SECTION 2. (a) The Expanded Learning Opportunities Council |
---|
138 | 138 | | shall submit the initial report required under Subchapter G, |
---|
139 | 139 | | Chapter 33, Education Code, as added by this Act, not later than |
---|
140 | 140 | | November 1, 2014. |
---|
141 | 141 | | (b) Not later than December 31, 2013, the commissioner of |
---|
142 | 142 | | education shall appoint the members of the Expanded Learning |
---|
143 | 143 | | Opportunities Council under Subchapter G, Chapter 33, Education |
---|
144 | 144 | | Code, as added by this Act. |
---|
145 | 145 | | SECTION 3. This Act takes effect immediately if it receives |
---|
146 | 146 | | a vote of two-thirds of all the members elected to each house, as |
---|
147 | 147 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
148 | 148 | | Act does not receive the vote necessary for immediate effect, this |
---|
149 | 149 | | Act takes effect September 1, 2013. |
