7 | 7 | | relating to the requirement that certain schoolchildren be screened |

8 | 8 | | for abnormal spinal curvature. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subsections (b) and (c), Section 37.001, Health |
---|
11 | 11 | | and Safety Code, are amended to read as follows: |
---|
12 | 12 | | (b) The board, in cooperation with the Texas Education |
---|
13 | 13 | | Agency, shall adopt rules requiring each public school to choose |
---|
14 | 14 | | either to participate in the [for the mandatory] spinal screening |
---|
15 | 15 | | program for [of] children in grades 6 and 9 attending the public [or |
---|
16 | 16 | | private] school or to provide information developed by the |
---|
17 | 17 | | department on abnormal spinal curvature to the parents, managing |
---|
18 | 18 | | conservators, or guardians of children in grades 6 through 9 |
---|
19 | 19 | | attending the public school [schools]. The department shall |
---|
20 | 20 | | coordinate the spinal screening program with any other screening |
---|
21 | 21 | | program conducted by the department on those children. |
---|
22 | 22 | | (c) The board shall adopt substantive and procedural rules |
---|
23 | 23 | | necessary to administer screening activities and for the |
---|
24 | 24 | | development and provision of information on abnormal spinal |
---|
25 | 25 | | curvature. |
---|
26 | 26 | | SECTION 2. Section 37.002, Health and Safety Code, is |
---|
27 | 27 | | amended to read as follows: |
---|
28 | 28 | | Sec. 37.002. [COMPLIANCE WITH] SCREENING REQUIREMENTS. |
---|
29 | 29 | | (a) If a public school requires an [Each] individual [required by |
---|
30 | 30 | | board rule] to be screened, the individual shall undergo approved |
---|
31 | 31 | | screening for abnormal spinal curvature. The individual's parent, |
---|
32 | 32 | | managing conservator, or guardian may substitute professional |
---|
33 | 33 | | examinations for the screening. |
---|
34 | 34 | | (b) An individual is exempt from screening if screening |
---|
35 | 35 | | conflicts with the tenets and practices of a recognized church or |
---|
36 | 36 | | religious denomination of which the individual is an adherent or a |
---|
37 | 37 | | member. To qualify for the exemption, the individual's parent, |
---|
38 | 38 | | managing conservator, or guardian must submit to the chief |
---|
39 | 39 | | administrator on or before the day of the screening procedure an |
---|
40 | 40 | | affidavit stating the objections to screening. The chief |
---|
41 | 41 | | administrator must make the information on abnormal spinal |
---|
42 | 42 | | curvature developed under Section 37.001 available to the exempted |
---|
43 | 43 | | individual's parent, managing conservator, or guardian. |
---|
44 | 44 | | (c) If screening is required, the [The] chief administrator |
---|
45 | 45 | | of each school shall ensure that each individual admitted to the |
---|
46 | 46 | | school complies with the screening requirements set by the board or |
---|
47 | 47 | | submits an affidavit of exemption. |
---|
48 | 48 | | SECTION 3. Not later than March 1, 2014, the Department of |
---|
49 | 49 | | State Health Services shall develop the information required by |
---|
50 | 50 | | Subsection (b), Section 37.001, Health and Safety Code, as amended |
---|
51 | 51 | | by this Act. |
---|
52 | 52 | | SECTION 4. This Act applies beginning with the 2014-2015 |
---|
53 | 53 | | school year. |
---|
54 | 54 | | SECTION 5. This Act takes effect immediately if it receives |
---|
55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
---|
56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
---|
58 | 58 | | Act takes effect September 1, 2013. |
