99 relating to the installation, maintenance, operation, and
1010 relocation of saltwater pipeline facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 91, Natural Resources Code, is amended
1313 by adding Subchapter T to read as follows:
1414 SUBCHAPTER T. SALTWATER PIPELINES
1515 Sec. 91.901. DEFINITIONS. In this subchapter:
1616 (1) "Saltwater pipeline facility" means a pipeline
1717 facility that conducts water containing salt and other substances
1818 produced during drilling or operating an oil, gas, or other type of
1919 well. The term includes a pipeline facility that conducts flowback
2020 and produced water from an oil or gas well on which a hydraulic
2121 fracturing treatment has been performed to an oil and gas waste
2222 disposal well for disposal.
2323 (2) "Saltwater pipeline operator" means a person who
2424 owns, installs, manages, operates, leases, or controls a saltwater
2525 pipeline facility.
2626 Sec. 91.902. PIPELINE ON PUBLIC ROAD. A saltwater pipeline
2727 operator is entitled to install, maintain, and operate a saltwater
2828 pipeline facility through, under, along, across, or over a public
2929 road only if:
3030 (1) the pipeline facility complies with applicable
3131 rules adopted by the Texas Transportation Commission and applicable
3232 county and municipal regulations regarding the accommodation of
3333 utility facilities on a public road or right-of-way, including
3434 regulations relating to the horizontal or vertical placement of the
3535 pipeline facility;
3636 (2) the saltwater pipeline operator ensures that the
3737 public road and associated facilities are promptly restored to
3838 their former condition of usefulness after the installation or
3939 maintenance of the pipeline facility is complete; and
4040 (3) the saltwater pipeline operator leases the
4141 right-of-way or area in which the pipeline facility is installed
4242 and pays to the applicable governmental entity the fair market
4343 value of the operator's use of the right-of-way or area, unless the
4444 operator is authorized by other law to install, maintain, and
4545 operate the pipeline facility through, under, along, across, or
4646 over the public road.
4747 Sec. 91.903. RELOCATION OF SALTWATER PIPELINE FACILITY FOR
4848 CERTAIN PURPOSES. (a) Except as provided by Section 203.092,
4949 Transportation Code, the Texas Transportation Commission, the
5050 commissioners court of a county, or the governing body of a
5151 municipality, as applicable, may require a saltwater pipeline
5252 operator to relocate a saltwater pipeline facility at the cost of
5353 the saltwater pipeline operator to accommodate construction or
5454 expansion of a public road or for any other public work unless the
5555 saltwater pipeline operator has a property interest in the land
5656 occupied by the facility to be relocated.
5757 (b) The Texas Transportation Commission, the commissioners
5858 court of a county, or the governing body of a municipality, as
5959 applicable, shall give to the saltwater pipeline operator 30 days'
6060 written notice of the requirement. The notice must identify the
6161 pipeline facility to be relocated and indicate the approximate
6262 location on the new right-of-way where the saltwater pipeline
6363 operator may place the facility.
6464 Sec. 91.904. CONSTRUCTION OF SUBCHAPTER. This subchapter
6565 may not be construed to:
6666 (1) limit the authority of a saltwater pipeline
6767 facility to use a public right-of-way under any other law;
6868 (2) affect the authority of a municipality to:
6969 (A) regulate the use of a public right-of-way by
7070 a saltwater pipeline operator under any other law; or
7171 (B) require payment of any applicable charge
7272 under Section 182.025, Tax Code; or
7373 (3) require a county or municipality to:
7474 (A) grant a right to a saltwater pipeline
7575 operator that applies to a public road or right-of-way and that is
7676 broader than the county's or municipality's legal interest in the
7777 public road or right-of-way; or
7878 (B) grant more than a surface right to a
7979 saltwater pipeline operator in a right-of-way acquired by
8080 prescription.
8181 Sec. 91.905. APPLICATION OF OTHER LAW. Section 212.153(e),
8282 Local Government Code, and Sections 203.092, 224.008, and
8383 502.1981(c)(4), Transportation Code, apply to saltwater pipeline
8484 operators and saltwater pipeline facilities in the same manner as
8585 they apply to utilities and utility facilities.
8686 SECTION 2. This Act takes effect immediately if it receives
8787 a vote of two-thirds of all the members elected to each house, as
8888 provided by Section 39, Article III, Texas Constitution. If this
8989 Act does not receive the vote necessary for immediate effect, this
9090 Act takes effect September 1, 2013.
