77 relating to the creation of the offense of installation, transfer,
88 use, or possession of an automated sales suppression device or

1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle B, Title 10, Business & Commerce Code,
1212 is amended by adding Chapter 326 to read as follows:
1313 CHAPTER 326. AUTOMATED SALES SUPPRESSION DEVICES; PHANTOM-WARE
1414 Sec. 326.001. DEFINITIONS. In this chapter:
1515 (1) "Automated sales suppression device" means a
1616 device or software program that falsifies an electronic record,
1717 including transaction data or a transaction report, of an
1818 electronic cash register or other point-of-sale system. The term
1919 includes a device that carries the software program or an Internet
2020 link to the software program.
2121 (2) "Electronic cash register" means a device or
2222 point-of-sale system that maintains a register or documentation
2323 through an electronic device or computer system that is designed to
2424 record transaction data for the purpose of computing, compiling, or
2525 processing retail sales transaction data.
2626 (3) "Phantom-ware" means a hidden programming option
2727 that is embedded in the operating system of an electronic cash
2828 register or hardwired into an electronic cash register and that may
2929 be used to create a second set of transaction reports or to
3030 eliminate or manipulate an original transaction report, which may
3131 or may not be preserved in a digital format, to represent the
3232 original or manipulated report of a transaction in the electronic
3333 cash register.
3434 (4) "Transaction data" includes data identifying an
3535 item purchased by a customer, a price for an item, a taxability
3636 determination for an item, a segregated tax amount for an item, an
3737 amount of cash or credit tendered for an item, a net amount of cash
3838 returned to a customer who purchased an item, a date or time of a
3939 purchase, a receipt or invoice number for a transaction, and a
4040 vendor's name, address, or identification number.
4141 (5) "Transaction report" means a report that:
4242 (A) contains documentation of each sale, amount
4343 of tax or fee collected, media total, or discount void at an
4444 electronic cash register and that is printed on a cash register tape
4545 at the end of a day or a shift; or
4646 (B) documents every action at an electronic cash
4747 register and is stored electronically.
4848 Sec. 326.002. AUTOMATED SALES SUPPRESSION DEVICES AND
4949 PHANTOM-WARE PROHIBITED; CRIMINAL OFFENSE. (a) A person commits
5050 an offense if the person knowingly sells, purchases, installs,
5151 transfers, uses, or possesses an automated sales suppression device
5252 or phantom-ware.
5353 (b) An offense under this section is a state jail felony.
5454 SECTION 2. Subdivision (2), Article 59.01, Code of Criminal
5555 Procedure, is amended to read as follows:
5656 (2) "Contraband" means property of any nature,
5757 including real, personal, tangible, or intangible, that is:
5858 (A) used in the commission of:
5959 (i) any first or second degree felony under
6060 the Penal Code;
6161 (ii) any felony under Section 15.031(b),
6262 20.05, 21.11, 38.04, or Chapter 43, 20A, 29, 30, 31, 32, 33, 33A, or
6363 35, Penal Code;
6464 (iii) any felony under The Securities Act
6565 (Article 581-1 et seq., Vernon's Texas Civil Statutes); or
6666 (iv) any offense under Chapter 49, Penal
6767 Code, that is punishable as a felony of the third degree or state
6868 jail felony, if the defendant has been previously convicted three
6969 times of an offense under that chapter;
7070 (B) used or intended to be used in the commission
7171 of:
7272 (i) any felony under Chapter 481, Health
7373 and Safety Code (Texas Controlled Substances Act);
7474 (ii) any felony under Chapter 483, Health
7575 and Safety Code;
7676 (iii) a felony under Chapter 153, Finance
7777 Code;
7878 (iv) any felony under Chapter 34, Penal
7979 Code;
8080 (v) a Class A misdemeanor under Subchapter
8181 B, Chapter 365, Health and Safety Code, if the defendant has been
8282 previously convicted twice of an offense under that subchapter;
8383 (vi) any felony under Chapter 152, Finance
8484 Code;
8585 (vii) any felony under Chapter 32, Human
8686 Resources Code, or Chapter 31, 32, 35A, or 37, Penal Code, that
8787 involves the state Medicaid program;
8888 (viii) a Class B misdemeanor under Chapter
8989 522, Business & Commerce Code;
9090 (ix) a Class A misdemeanor under Section
9191 306.051, Business & Commerce Code;
9292 (x) any offense under Section 42.10, Penal
9393 Code;
9494 (xi) any offense under Section 46.06(a)(1)
9595 or 46.14, Penal Code;
9696 (xii) any offense under Chapter 71, Penal
9797 Code; [or]
9898 (xiii) any offense under Section 20.05,
9999 Penal Code; or
100100 (xiv) an offense under Section 326.002,
101101 Business & Commerce Code;
102102 (C) the proceeds gained from the commission of a
103103 felony listed in Paragraph (A) or (B) of this subdivision, a
104104 misdemeanor listed in Paragraph (B)(viii), (x), (xi), or (xii) of
105105 this subdivision, or a crime of violence;
106106 (D) acquired with proceeds gained from the
107107 commission of a felony listed in Paragraph (A) or (B) of this
108108 subdivision, a misdemeanor listed in Paragraph (B)(viii), (x),
109109 (xi), or (xii) of this subdivision, or a crime of violence;
110110 (E) used to facilitate or intended to be used to
111111 facilitate the commission of a felony under Section 15.031 or
112112 43.25, Penal Code; or
113113 (F) used to facilitate or intended to be used to
114114 facilitate the commission of a felony under Section 20A.02 or
115115 Chapter 43, Penal Code.
116116 SECTION 3. This Act takes effect September 1, 2013.
