| 8 | 8 | | institutions of higher education under energy savings performance |
|---|

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 51.927, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (l) to read as follows: |
|---|
| 13 | 13 | | (l) The guidelines established under Subsection (i) must |
|---|
| 14 | 14 | | require the Texas Higher Education Coordinating Board to: |
|---|
| 15 | 15 | | (1) review any reports submitted to the board that |
|---|
| 16 | 16 | | measure and verify cost savings to an institution of higher |
|---|
| 17 | 17 | | education under an energy savings performance contract; and |
|---|
| 18 | 18 | | (2) based on the reports, provide an analysis, on a |
|---|
| 19 | 19 | | periodic basis, of the cost savings under the energy savings |
|---|
| 20 | 20 | | performance contract to the governing board of the institution of |
|---|
| 21 | 21 | | higher education and the Legislative Budget Board until the |
|---|
| 22 | 22 | | governing board of the institution of higher education determines |
|---|
| 23 | 23 | | that the analysis is no longer required to accurately measure cost |
|---|
| 24 | 24 | | savings. |

| 25 | 25 | | SECTION 2. Section 2166.406, Government Code, is amended by |
|---|
| 26 | 26 | | adding Subsection (l) to read as follows: |
|---|
| 27 | 27 | | (l) The guidelines adopted under Subsection (i) must |
|---|
| 28 | 28 | | require the State Energy Conservation Office to: |
|---|
| 29 | 29 | | (1) review any reports submitted to the office that |
|---|
| 30 | 30 | | measure and verify cost savings to a state agency under an energy |
|---|
| 31 | 31 | | savings performance contract; and |
|---|
| 32 | 32 | | (2) based on the reports, provide an analysis, on a |
|---|
| 33 | 33 | | periodic basis, of the cost savings under the energy savings |
|---|
| 34 | 34 | | performance contract to the state agency and the Legislative Budget |
|---|
| 35 | 35 | | Board until the state agency determines that the analysis is no |
|---|
| 36 | 36 | | longer required to accurately measure cost savings. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2013. |
|---|
