9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subsection (o), Section 442.005, Government |
---|
11 | 11 | | Code, is amended to read as follows: |
---|
12 | 12 | | (o) The commission may enter into contracts with other state |
---|
13 | 13 | | agencies or institutions, [and with] qualified private |
---|
14 | 14 | | institutions, and other persons, including for-profit |
---|
15 | 15 | | corporations, to carry out the purposes of this chapter. A contract |
---|
16 | 16 | | with a for-profit corporation under this chapter may not permit any |
---|
17 | 17 | | property preserved, maintained, or administered by the commission |
---|
18 | 18 | | under this chapter to display any corporate name, logo, or product |
---|
19 | 19 | | other than a discreet plaque or similar acknowledgment that does |
---|
20 | 20 | | not detract from the property's historic purpose. |
---|
21 | 21 | | SECTION 2. Subsection (b), Section 442.0056, Government |
---|
22 | 22 | | Code, is amended to read as follows: |
---|
23 | 23 | | (b) The commission shall restore and maintain each historic |
---|
24 | 24 | | site acquired under this section for the benefit of the general |
---|
25 | 25 | | public. The commission may enter into interagency contracts and |
---|
26 | 26 | | contracts with other persons, including for-profit corporations, |
---|
27 | 27 | | for this purpose. |

28 | 28 | | SECTION 3. Subsection (c), Section 442.007, Government |
---|
29 | 29 | | Code, is amended to read as follows: |
---|
30 | 30 | | (c) The commission may enter into contracts or cooperative |
---|
31 | 31 | | agreements with the federal government, other state agencies, state |
---|
32 | 32 | | or private museums or educational institutions, or qualified |
---|
33 | 33 | | persons, including for-profit corporations, [individuals] for |
---|
34 | 34 | | prehistoric or historic archeological investigations, surveys, |
---|
35 | 35 | | excavations, or restorations in this state. |
---|
36 | 36 | | SECTION 4. Subsection (c), Section 442.072, Government |
---|
37 | 37 | | Code, is amended to read as follows: |
---|
38 | 38 | | (c) The commission may enter into an agreement with a |
---|
39 | 39 | | nonprofit or for-profit corporation, foundation, association, or |
---|
40 | 40 | | other nonprofit or for-profit entity for the expansion, renovation, |
---|
41 | 41 | | management, operation, or financial support of a historic site. |
---|
42 | 42 | | SECTION 5. Subsection (d), Section 442.075, Government |
---|
43 | 43 | | Code, is amended to read as follows: |
---|
44 | 44 | | (d) On or after the transfer of jurisdiction over a historic |
---|
45 | 45 | | site, the commission may enter into an agreement with a nonprofit or |
---|
46 | 46 | | for-profit corporation, including the Admiral Nimitz Foundation, |
---|
47 | 47 | | for the expansion, renovation, management, operation, or financial |
---|
48 | 48 | | support of the site. |
---|
49 | 49 | | SECTION 6. Subsection (b), Section 442.101, Government |
---|
50 | 50 | | Code, is amended to read as follows: |
---|
51 | 51 | | (b) The commission may contract with any appropriate |
---|
52 | 52 | | entity, including a for-profit corporation, for services necessary |
---|
53 | 53 | | to carry out its responsibilities regarding historic sites |
---|
54 | 54 | | described by Subchapter C. |
---|
55 | 55 | | SECTION 7. The changes in law made by this Act apply only to |
---|
56 | 56 | | a contract entered into by the Texas Historical Commission on or |
---|
57 | 57 | | after the effective date of this Act. |
---|
58 | 58 | | SECTION 8. This Act takes effect September 1, 2013. |
