77 relating to the contracting authority of the Texas Historical

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (o), Section 442.005, Government
1111 Code, is amended to read as follows:
1212 (o) The commission may enter into contracts with other state
1313 agencies or institutions, [and with] qualified private
1414 institutions, and other persons, including for-profit
1515 corporations, to carry out the purposes of this chapter. A contract
1616 with a for-profit corporation under this chapter may not permit any
1717 property preserved, maintained, or administered by the commission
1818 under this chapter to display any corporate name, logo, or product
1919 other than a discreet plaque or similar acknowledgment that does
2020 not detract from the property's historic purpose.
2121 SECTION 2. Subsection (b), Section 442.0056, Government
2222 Code, is amended to read as follows:
2323 (b) The commission shall restore and maintain each historic
2424 site acquired under this section for the benefit of the general
2525 public. The commission may enter into interagency contracts and
2626 contracts with other persons, including for-profit corporations,
2727 for this purpose.
2828 SECTION 3. Subsection (c), Section 442.007, Government
2929 Code, is amended to read as follows:
3030 (c) The commission may enter into contracts or cooperative
3131 agreements with the federal government, other state agencies, state
3232 or private museums or educational institutions, or qualified
3333 persons, including for-profit corporations, [individuals] for
3434 prehistoric or historic archeological investigations, surveys,
3535 excavations, or restorations in this state.
3636 SECTION 4. Subsection (c), Section 442.072, Government
3737 Code, is amended to read as follows:
3838 (c) The commission may enter into an agreement with a
3939 nonprofit or for-profit corporation, foundation, association, or
4040 other nonprofit or for-profit entity for the expansion, renovation,
4141 management, operation, or financial support of a historic site.
4242 SECTION 5. Subsection (d), Section 442.075, Government
4343 Code, is amended to read as follows:
4444 (d) On or after the transfer of jurisdiction over a historic
4545 site, the commission may enter into an agreement with a nonprofit or
4646 for-profit corporation, including the Admiral Nimitz Foundation,
4747 for the expansion, renovation, management, operation, or financial
4848 support of the site.
4949 SECTION 6. Subsection (b), Section 442.101, Government
5050 Code, is amended to read as follows:
5151 (b) The commission may contract with any appropriate
5252 entity, including a for-profit corporation, for services necessary
5353 to carry out its responsibilities regarding historic sites
5454 described by Subchapter C.
5555 SECTION 7. The changes in law made by this Act apply only to
5656 a contract entered into by the Texas Historical Commission on or
5757 after the effective date of this Act.
5858 SECTION 8. This Act takes effect September 1, 2013.
