66 AN ACT
77 relating to the elimination of the licensing and registration
88 requirements for ringside physicians and timekeepers for combative
99 sports events.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subdivision (20), Section 2052.002, Occupations
1212 Code, is amended to read as follows:
1313 (20) "Ringside physician" means an individual who has
1414 an unrestricted and unlimited license [licensed] to practice
1515 medicine in this state and who, by agreement, is assigned as the
1616 physician for a combative sports event [registered with the
1717 department].
1818 SECTION 2. Subsection (b), Section 2052.052, Occupations
1919 Code, is amended to read as follows:
2020 (b) The commission may adopt rules:
2121 (1) governing boxing, kickboxing, martial arts, or
2222 mixed martial arts contests and exhibitions;
2323 (2) establishing reasonable qualifications for an
2424 applicant seeking a license or registration from the department
2525 under this chapter;
2626 (3) recognizing a sanction, medical suspension, or
2727 disqualification of a licensee or registrant by a combative sports
2828 authority in any state, provided that if licensure or registration
2929 is denied based on those actions, an applicant has an opportunity
3030 for a hearing as prescribed by rule;
3131 (4) establishing selection criteria and procedures
3232 for the assignment of individuals who agree to act as ringside
3333 physicians and timekeepers for combative sports events [practice
3434 requirements or specialty certifications that a person licensed to
3535 practice medicine in this state must meet to register as a ringside
3636 physician];
3737 (5) requiring a contestant to present with an
3838 application for licensure or license renewal documentation of
3939 recent blood test results that demonstrate whether the contestant
4040 is free from hepatitis B virus, hepatitis C virus, human
4141 immunodeficiency virus, and any other communicable disease
4242 designated by commission rule and providing that a contestant's
4343 failure to provide the required blood test results disqualifies the
4444 contestant;
4545 (6) providing that to participate in any event a
4646 contestant must be free of hepatitis B virus, hepatitis C virus,
4747 human immunodeficiency virus, and any other communicable disease
4848 designated by rule;
4949 (7) requiring that a contestant present with an
5050 application for licensure or license renewal documentation of the
5151 results of a physical examination, including an ophthalmologic
5252 examination, and providing for disqualification of a contestant who
5353 is determined by an examining physician to be unfit;
5454 (8) establishing additional responsibilities for
5555 promoters; and
5656 (9) governing regulated amateur events.
5757 SECTION 3. Section 2052.107, Occupations Code, is amended
5858 to read as follows:
5959 Sec. 2052.107. OTHER COMBATIVE SPORTS LICENSES. Unless a
6060 person holds a license or registration issued under this chapter,
6161 the person may not act as a combative sports:
6262 (1) professional contestant;
6363 (2) manager of a professional contestant;
6464 (3) referee;
6565 (4) judge;
6666 (5) second;
6767 (6) [timekeeper;
6868 [(7)] matchmaker;
6969 [(8) ringside physician;] or
7070 (7) [(9)] event coordinator.
7171 SECTION 4. (a) A disciplinary or administrative
7272 proceeding pending under Chapter 51 or 2052, Occupations Code, that
7373 is related to a violation of licensing or registration requirements
7474 for a timekeeper or ringside physician under Chapter 2052,
7575 Occupations Code, as that chapter existed immediately before the
7676 effective date of this Act, is dismissed.
7777 (b) An administrative penalty assessed by the Texas
7878 Commission of Licensing and Regulation or the executive director of
7979 the Texas Department of Licensing and Regulation under Chapter
8080 2052, Occupations Code, related to a violation of Chapter 2052,
8181 Occupations Code, as that chapter existed immediately before the
8282 effective date of this Act, may be collected as provided by Chapter
8383 51, Occupations Code.
8484 (c) The change in law made by this Act does not affect the
8585 pending prosecution of an offense under Chapter 2052, Occupations
8686 Code, as that chapter existed immediately before the effective date
8787 of this Act. An offense committed before the effective date of this
8888 Act is governed by the law in effect at the time the offense was
8989 committed, and the former law is continued in effect for that
9090 purpose. For purposes of this section, an offense was committed
9191 before the effective date of this Act if any element of the offense
9292 occurred before that date.
9393 (d) As soon as practicable after the effective date of this
9494 Act, the Texas Department of Licensing and Regulation shall return
9595 a prorated portion of the fee paid to the department for the
9696 issuance or renewal of the registration or license to a person who
9797 holds a valid registration as a ringside physician or timekeeper
9898 issued under Chapter 2052, Occupations Code, as that chapter
9999 existed immediately before the effective date of this Act.
100100 SECTION 5. This Act takes effect September 1, 2013.
