99 AN ACT
1010 relating to a program to recognize public schools with successful
1111 student health and fitness programs.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1414 amended by adding Section 38.027 to read as follows:
1515 Sec. 38.027. HEALTHY SCHOOLS RECOGNITION PROGRAM. (a) The
1616 commissioner shall establish a healthy schools recognition program
1717 under which schools are recognized for successfully implementing
1818 programs that encourage student health and fitness.
1919 (b) A school may apply to the commissioner for recognition
2020 as a gold, silver, or bronze healthy school. The commissioner shall
2121 determine whether a school qualifies for recognition and the level
2222 for which the school qualifies based on:
2323 (1) improvement in the results of the physical fitness
2424 assessment instrument administered under Subchapter C;
2525 (2) implementation of a coordinated health program
2626 under Section 38.014, if the school applying for recognition is an
2727 elementary school, middle school, or junior high school;
2828 (3) the involvement of the local school health
2929 advisory council established under Section 28.004;
3030 (4) compliance with student minimum physical activity
3131 requirements under Section 28.002(l);
3232 (5) recent recognition, by a public or private entity
3333 approved for the purpose by the commissioner, for successfully
3434 implementing a program that encourages student health or fitness;
3535 and
3636 (6) any other criteria adopted by the commissioner.
3737 (c) The commissioner may establish partnerships with
3838 private and nonprofit entities to provide monetary and in-kind
3939 rewards to schools that receive recognition under the program as a
4040 healthy school.
4141 (d) The commissioner may solicit and accept a gift, grant,
4242 or donation from any source for the development or implementation
4343 of the program. Only a gift, grant, or donation may be used to fund
4444 development or implementation of the program.
4545 (e) The commissioner shall adopt rules necessary to
4646 implement this section.
4747 SECTION 2. This Act applies beginning with the 2013-2014
4848 school year.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2013.
