83R2527 KFF-D By: Campbell S.B. No. 682 A BILL TO BE ENTITLED AN ACT relating to reimbursement for services provided by advanced practice nurses and physician assistants under the Medicaid program. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter B, Chapter 32, Human Resources Code, is amended by adding Section 32.0426 to read as follows: Sec. 32.0426. REIMBURSEMENT FOR SERVICES PROVIDED BY ADVANCED PRACTICE NURSES AND PHYSICIAN ASSISTANTS. (a) In this section: (1) "Advanced practice nurse" has the meaning assigned by Section 301.152, Occupations Code. (2) "National provider identifier" means the national provider identifier required under Section 1128J(e), Social Security Act (42 U.S.C. Section 1320a-7k(e)). (3) "Physician assistant" means a person who holds a license issued under Chapter 204, Occupations Code. (b) If an advanced practice nurse or a physician assistant provides a service to a recipient under the medical assistance program at the direction or under the supervision of another provider and the advanced practice nurse or physician assistant, as applicable, is the primary provider of the service: (1) the name and associated national provider identifier of the advanced practice nurse or physician assistant, as applicable, must be included as the rendering provider on any claim for reimbursement submitted by a provider; and (2) the department may reimburse the claim only at the provider level established by rule for an advanced practice nurse or physician assistant, as applicable. (c) The executive commissioner of the Health and Human Services Commission may adopt rules necessary to implement this section. SECTION 2. If before implementing any provision of this Act a state agency determines that a waiver or authorization from a federal agency is necessary for implementation of that provision, the agency affected by the provision shall request the waiver or authorization and may delay implementing that provision until the waiver or authorization is granted. SECTION 3. This Act takes effect September 1, 2013.
