6	6	AN ACT
7	7	relating to the established schedule of payments from the
8	8	foundation school fund of the yearly entitlement of certain school
9	9	districts.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 42.259, Education Code, is amended by
12	12	amending Subsections (c), (d), and (f) and adding Subsections (c-1)
13	13	and (d-1) to read as follows:
14	14	(c) Payments from the foundation school fund to each
15	15	category 2 school district shall be made as follows:
16	16	(1) 22 percent of the yearly entitlement of the
17	17	district shall be paid in an installment to be made on or before the
18	18	25th day of September of a fiscal year;
19	19	(2) 18 percent of the yearly entitlement of the
20	20	district shall be paid in an installment to be made on or before the
21	21	25th day of October;
22	22	(3) 9.5 percent of the yearly entitlement of the
23	23	district shall be paid in an installment to be made on or before the
24	24	25th day of November;
25	25	(4) 7.5 percent of the yearly entitlement of the
26	26	district shall be paid in an installment to be made on or before the
27	27	25th day of April;
28	28	(5) five percent of the yearly entitlement of the
29	29	district shall be paid in an installment to be made on or before the
30	30	25th day of May;
31	31	(6) 10 percent of the yearly entitlement of the
32	32	district shall be paid in an installment to be made on or before the
33	33	25th day of June;
34	34	(7) 13 percent of the yearly entitlement of the
35	35	district shall be paid in an installment to be made on or before the
36	36	25th day of July; and
37	37	(8) 15 percent of the yearly entitlement of the
38	38	district shall be paid in an installment to be made on or before the
39	39	25th day of August [after the 5th day of September and not later
40	40	than the 10th day of September of the calendar year following the
41	41	calendar year of the payment made under Subdivision (1)].
42	42	(c-1) Notwithstanding Subsection (c)(8), for the state
43	43	fiscal year ending August 31, 2013, the installment described by
44	44	that subdivision shall be paid on or before the 30th day of August,
45	45	2013. This subsection expires August 31, 2013.
46	46	(d) Payments from the foundation school fund to each
47	47	category 3 school district shall be made as follows:
48	48	(1) 45 percent of the yearly entitlement of the
49	49	district shall be paid in an installment to be made on or before the
50	50	25th day of September of a fiscal year;
51	51	(2) 35 percent of the yearly entitlement of the
52	52	district shall be paid in an installment to be made on or before the
53	53	25th day of October; and
54	54	(3) 20 percent of the yearly entitlement of the
55	55	district shall be paid in an installment to be made on or before the
56	56	25th day of August [after the 5th day of September and not later
57	57	than the 10th day of September of the calendar year following the
58	58	calendar year of the payment made under Subdivision (1)].
59	59	(d-1) Notwithstanding Subsection (d)(3), for the state
60	60	fiscal year ending August 31, 2013, the installment described by
61	61	that subdivision shall be paid on or before the 30th day of August,
62	62	2013. This subsection expires August 31, 2013.
63	63	(f) Previously [Except as provided by Subsection (c)(8) or
64	64	(d)(3), any previously] unpaid additional funds from prior fiscal
65	65	years owed to a district shall be paid to the district together with
66	66	the September payment of the current fiscal year entitlement.
67	67	SECTION 2. Subsection (c), Section 466.355, Government
68	68	Code, is amended to read as follows:
69	69	(c) Each August the comptroller shall:
70	70	(1) estimate the amount to be transferred to the
71	71	foundation school fund on or before September 15; and
72	72	(2) notwithstanding Subsection (b)(4), transfer the
73	73	amount estimated in Subdivision (1) to the foundation school fund
74	74	before August installment payments are made under Section 42.259,
75	75	Education Code [25].
76	76	SECTION 3. The changes made by this Act to Section 42.259,
77	77	Education Code, apply only to a payment from the foundation school
78	78	fund that is made on or after the effective date of this Act. A
79	79	payment to a school district from the foundation school fund that is
80	80	made before that date is governed by Section 42.259, Education
81	81	Code, as it existed before amendment by this Act, and the former law
82	82	is continued in effect for that purpose.
83	83	SECTION 4. This Act takes effect immediately if it receives
84	84	a vote of two-thirds of all the members elected to each house, as
85	85	provided by Section 39, Article III, Texas Constitution. If this
86	86	Act does not receive the vote necessary for immediate effect, this
87	87	Act takes effect on the 91st day after the last day of the
88	88	legislative session.
