77 relating to the authority of the Department of State Health
88 Services to admit certain nonresident tuberculosis patients to a
99 state chest hospital.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 13.046, Health and Safety Code, is
1212 amended by adding Subsections (c) and (d) to read as follows:
1313 (c) The commissioner may admit a person to a state chest
1414 hospital if:
1515 (1) the person is in the custody of United States
1616 Immigration and Customs Enforcement, or other appropriate federal
1717 agency, pending completion of deportation or political asylum
1818 proceedings or has been released from custody pending completion of
1919 the proceedings; and
2020 (2) the commissioner determines the person is a
2121 tuberculosis patient.
2222 (d) If the commissioner admits a tuberculosis patient under
2323 Subsection (c), the department shall attempt to recover from the
2424 appropriate federal agency the costs associated with the treatment
2525 of the patient.
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2013.
