10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 13.046, Health and Safety Code, is | |
12 | 12 | amended by adding Subsections (c) and (d) to read as follows: | |
13 | 13 | (c) The commissioner may admit a person to a state chest | |
14 | 14 | hospital if: | |
15 | 15 | (1) the person is in the custody of United States | |
16 | 16 | Immigration and Customs Enforcement, or other appropriate federal | |
17 | 17 | agency, pending completion of deportation or political asylum | |
18 | 18 | proceedings or has been released from custody pending completion of | |
19 | 19 | the proceedings; and | |
20 | 20 | (2) the commissioner determines the person is a | |
21 | 21 | tuberculosis patient. | |
22 | 22 | (d) If the commissioner admits a tuberculosis patient under | |
23 | 23 | Subsection (c), the department shall attempt to recover from the | |
24 | 24 | appropriate federal agency the costs associated with the treatment | |
25 | 25 | of the patient. | |
26 | 26 | SECTION 2. This Act takes effect immediately if it receives | |
27 | 27 | a vote of two-thirds of all the members elected to each house, as | |
28 | 28 | provided by Section 39, Article III, Texas Constitution. If this | |
29 | 29 | Act does not receive the vote necessary for immediate effect, this | |
30 | 30 | Act takes effect September 1, 2013. |
