66 AN ACT
77 relating to certain requirements for political parties holding
88 conventions and for officers of certain of those parties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 161.005, Election Code, is amended by
1111 amending Subsection (a) and adding Subsection (c) to read as
1212 follows:
1313 (a) To be eligible to be a candidate for or to serve as a
1414 county or precinct chair of a political party, a person must:
1515 (1) be a qualified voter of the county; and
1616 (2) except as provided by Subsection (c), not be a
1717 candidate for nomination or election to, or be the holder of, an
1818 elective office of the federal, state, or county government.
1919 (c) A candidate for nomination or election to, or the holder
2020 of, an elective office of the federal, state, or county government
2121 is eligible to serve as a county or precinct chair of a political
2222 party to which Chapter 181 applies.
2323 SECTION 2. Section 163.002, Election Code, is amended to
2424 read as follows:
2525 Sec. 163.002. REQUIRED RULES. A political party that makes
2626 nominations in this state shall adopt rules that:
2727 (1) prescribe the parliamentary procedure governing
2828 the conduct of party meetings and conventions from the precinct
2929 level to the state level, including:
3030 (A) quorums;
3131 (B) casting and counting votes;
3232 (C) operation of executive committees;
3333 (D) appointment and duties of convention
3434 committees; and
3535 (E) presentation of matters before a convention;
3636 (2) prescribe the method of selecting the party's
3737 presidential elector candidates;
3838 (3) prescribe the manner of selecting party officers,
3939 convention delegates, any convention alternates, and convention
4040 officials;
4141 (4) provide for representative apportionment of party
4242 officers, convention delegates, any convention alternates, and
4343 convention officials throughout the state on the basis of
4444 population, party strength, or both, within the appropriate
4545 territorial unit;
4646 (5) provide for periodic publication and publicizing
4747 of party rules; and
4848 (6) prescribe the manner of adopting party rules and
4949 amendments to the rules.
5050 SECTION 3. Subsection (a), Section 181.061, Election Code,
5151 is amended to read as follows:
5252 (a) A political party nominating by convention must make its
5353 nominations for statewide offices at a state convention held on the
5454 second Saturday in April [June] of the election year, except that if
5555 the Sunday after the second Saturday in April in an election year is
5656 the date of the Easter holiday, the state convention must be held on
5757 the third Saturday in April of that year. The state convention
5858 consists of delegates selected at the county conventions held under
5959 Subsection (c).
6060 SECTION 4. This Act takes effect immediately if it receives
6161 a vote of two-thirds of all the members elected to each house, as
6262 provided by Section 39, Article III, Texas Constitution. If this
6363 Act does not receive the vote necessary for immediate effect, this
6464 Act takes effect September 1, 2013.
