88 AN ACT
99 relating to a list of mental health, substance abuse, and suicide
1010 prevention programs that may be selected for implementation by
1111 public schools.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. The heading to Subchapter O-1, Chapter 161,
1414 Health and Safety Code, is amended to read as follows:
1515 SUBCHAPTER O-1. [EARLY] MENTAL HEALTH, SUBSTANCE ABUSE,
1616 [INTERVENTION] AND [PREVENTION OF] YOUTH SUICIDE
1717 SECTION 2. The heading to Section 161.325, Health and
1818 Safety Code, is amended to read as follows:
1919 Sec. 161.325. [EARLY] MENTAL HEALTH PROMOTION AND
2020 INTERVENTION, SUBSTANCE ABUSE PREVENTION AND INTERVENTION, AND
2121 SUICIDE PREVENTION.
2222 SECTION 3. Section 161.325, Health and Safety Code, is
2323 amended by amending Subsections (a), (b), (d), (e), and (i) and
2424 adding Subsections (a-1) and (a-2) to read as follows:
2525 (a) The department, in coordination with the Texas
2626 Education Agency and regional education service centers, shall
2727 provide and annually update a list of recommended best
2828 practice-based programs in the areas specified under Subsection
2929 (a-1) [early mental health intervention and suicide prevention
3030 programs] for implementation in public elementary, junior high,
3131 middle, and high schools within the general education
3232 setting. Each school district may select from the list a program
3333 or programs appropriate for implementation in the district.
3434 (a-1) The list must include programs in the following areas:
3535 (1) early mental health intervention;
3636 (2) mental health promotion and positive youth
3737 development;
3838 (3) substance abuse prevention;
3939 (4) substance abuse intervention; and
4040 (5) suicide prevention.
4141 (a-2) The department, the Texas Education Agency, and each
4242 regional education service center shall make the list easily
4343 accessible on their websites.
4444 (b) The programs on the list must include components that
4545 provide for training counselors, teachers, nurses, administrators,
4646 and other staff, as well as law enforcement officers and social
4747 workers who regularly interact with students, to:
4848 (1) recognize students at risk of committing suicide,
4949 including students who are or may be the victims of or who engage in
5050 bullying;
5151 (2) recognize students displaying early warning signs
5252 and a possible need for early mental health or substance abuse
5353 intervention, which warning signs may include declining academic
5454 performance, depression, anxiety, isolation, unexplained changes
5555 in sleep or eating habits, and destructive behavior toward self and
5656 others; and
5757 (3) intervene effectively with students described by
5858 Subdivision (1) or (2) by providing notice and referral to a parent
5959 or guardian so appropriate action, such as seeking mental health or
6060 substance abuse services, may be taken by a parent or guardian.
6161 (d) The board of trustees of each school district may adopt
6262 a policy concerning [early] mental health promotion and
6363 intervention, substance abuse prevention and intervention, and
6464 suicide prevention that:
6565 (1) establishes a procedure for providing notice of a
6666 recommendation for early mental health or substance abuse
6767 intervention regarding a student to a parent or guardian of the
6868 student within a reasonable amount of time after the identification
6969 of early warning signs as described by Subsection (b)(2);
7070 (2) establishes a procedure for providing notice of a
7171 student identified as at risk of committing suicide to a parent or
7272 guardian of the student within a reasonable amount of time after the
7373 identification of early warning signs as described by Subsection
7474 (b)(2);
7575 (3) establishes that the district may develop a
7676 reporting mechanism and may designate at least one person to act as
7777 a liaison officer in the district for the purposes of identifying
7878 students in need of early mental health or substance abuse
7979 intervention or suicide prevention; and
8080 (4) sets out available counseling alternatives for a
8181 parent or guardian to consider when their child is identified as
8282 possibly being in need of early mental health or substance abuse
8383 intervention or suicide prevention.
8484 (e) The policy must prohibit the use without the prior
8585 consent of a student's parent or guardian of a medical screening of
8686 the student as part of the process of identifying whether the
8787 student is possibly in need of early mental health or substance
8888 abuse intervention or suicide prevention.
8989 (i) Nothing in this section is intended to interfere with
9090 the rights of parents or guardians and the decision-making
9191 regarding the best interest of the child. Policy and procedures
9292 adopted in accordance with this section are intended to notify a
9393 parent or guardian of a need for mental health or substance abuse
9494 intervention so that a parent or guardian may take appropriate
9595 action. Nothing in this section shall be construed as giving school
9696 districts the authority to prescribe medications. Any and all
9797 medical decisions are to be made by a parent or guardian of a
9898 student.
9999 SECTION 4. This Act takes effect September 1, 2013.
