9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 342.004, Health and Safety Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | Sec. 342.004. MUNICIPAL POWER CONCERNING WEEDS OR CERTAIN | |
13 | 13 | PUBLIC NUISANCES [OTHER UNSANITARY MATTER]. The governing body of | |
14 | 14 | a municipality may require the owner of real property [a lot] in the | |
15 | 15 | municipality to keep the property [lot] free from weeds, [rubbish,] | |
16 | 16 | brush, and a condition constituting a public nuisance as defined by | |
17 | 17 | Section 343.011(c)(1), (2), or (3) [other objectionable, | |
18 | 18 | unsightly, or unsanitary matter]. | |
19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
23 | 23 | Act takes effect September 1, 2013. |
