| 7 | 7 | | relating to the use of e-mail and website technology by the Texas |

| 8 | 8 | | Department of Licensing and Regulation. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 51.207, Occupations Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 51.207. USE OF TECHNOLOGY. (a) The commission shall |
|---|
| 13 | 13 | | develop and implement a policy requiring the executive director and |
|---|
| 14 | 14 | | department employees to research and propose appropriate |
|---|
| 15 | 15 | | technological solutions to improve the department's ability to |
|---|
| 16 | 16 | | perform its functions. The technological solutions must: |
|---|
| 17 | 17 | | (1) ensure that the public is able to easily find |
|---|
| 18 | 18 | | information about the department on the Internet; |
|---|
| 19 | 19 | | (2) ensure that persons who want to use the |
|---|
| 20 | 20 | | department's services are able to: |
|---|
| 21 | 21 | | (A) interact with the department through the |
|---|
| 22 | 22 | | Internet; and |
|---|
| 23 | 23 | | (B) access any service that can be provided |
|---|
| 24 | 24 | | effectively through the Internet; and |
|---|
| 25 | 25 | | (3) be cost-effective and developed through the |
|---|
| 26 | 26 | | department's planning processes. |

| 27 | 27 | | (b) The department shall provide on its Internet website a |
|---|
| 28 | 28 | | link to an Internet website that allows the public to track |
|---|
| 29 | 29 | | legislation affecting the programs administered by the department, |
|---|
| 30 | 30 | | which may be a website that provides legislative information |
|---|
| 31 | 31 | | administered by the Texas Legislature. |
|---|
| 32 | 32 | | (c) The department may satisfy any requirement under this |
|---|
| 33 | 33 | | chapter or another law governing a program subject to regulation by |
|---|
| 34 | 34 | | the department to provide notice by delivering the notice by e-mail |
|---|
| 35 | 35 | | to the recipient's last known e-mail address if the recipient has |
|---|
| 36 | 36 | | previously authorized the department to deliver the notice by |
|---|
| 37 | 37 | | e-mail. An e-mail address used under this subsection is |
|---|
| 38 | 38 | | confidential and is not subject to disclosure under Chapter 552, |
|---|
| 39 | 39 | | Government Code. |
|---|
| 40 | 40 | | SECTION 2. This Act takes effect September 1, 2013. |
