14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 15 | | SECTION 1. Subchapter A, Chapter 11, Alcoholic Beverage |
---|
16 | 16 | | Code, is amended by adding Section 11.043 to read as follows: |
---|
17 | 17 | | Sec. 11.043. DRIVING WHILE INTOXICATED PENALTIES SIGN. |
---|
18 | 18 | | (a) The commission by rule shall require the holder of a permit |
---|
19 | 19 | | authorizing the sale of alcoholic beverages for on-premises |
---|
20 | 20 | | consumption who does not hold a food and beverage certificate for |
---|
21 | 21 | | the premises to display a sign on the door to each restroom on the |
---|
22 | 22 | | permit holder's premises that informs the public of: |
---|
23 | 23 | | (1) the criminal penalties for a conviction of the |
---|
24 | 24 | | offense of driving while intoxicated; and |
---|
25 | 25 | | (2) the average costs a person convicted of driving |
---|
26 | 26 | | while intoxicated can expect to pay, including attorney's fees, |
---|
27 | 27 | | criminal fines, court costs, bail, driver's license surcharges, and |
---|
28 | 28 | | alcohol education course fees. |
---|
29 | 29 | | (b) The commission's rules shall specify the size and |
---|
30 | 30 | | graphic design, including font size and type, and the language of |
---|
31 | 31 | | the sign. The rules may require the permit holder to display the |
---|
32 | 32 | | sign in a language other than English if the commission determines |
---|
33 | 33 | | that a substantial portion of the expected customers of the |
---|
34 | 34 | | establishment speak a language other than English. |
