1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to requiring certain notices to be posted on the premises
1313 of certain alcoholic beverage retailers.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subchapter A, Chapter 11, Alcoholic Beverage
1616 Code, is amended by adding Section 11.043 to read as follows:
1717 Sec. 11.043. DRIVING WHILE INTOXICATED PENALTIES SIGN.
1818 (a) The commission by rule shall require the holder of a permit
1919 authorizing the sale of alcoholic beverages for on-premises
2020 consumption who does not hold a food and beverage certificate for
2121 the premises to display a sign on the door to each restroom on the
2222 permit holder's premises that informs the public of:
2323 (1) the criminal penalties for a conviction of the
2424 offense of driving while intoxicated; and
2525 (2) the average costs a person convicted of driving
2626 while intoxicated can expect to pay, including attorney's fees,
2727 criminal fines, court costs, bail, driver's license surcharges, and
2828 alcohol education course fees.
2929 (b) The commission's rules shall specify the size and
3030 graphic design, including font size and type, and the language of
3131 the sign. The rules may require the permit holder to display the
3232 sign in a language other than English if the commission determines
3333 that a substantial portion of the expected customers of the
3434 establishment speak a language other than English.
3535 SECTION 2. Subchapter A, Chapter 61, Alcoholic Beverage
3636 Code, is amended by adding Section 61.112 to read as follows:
3737 Sec. 61.112. DRIVING WHILE INTOXICATED PENALTIES SIGN.
3838 (a) The commission by rule shall require the holder of a license
3939 authorizing the sale of alcoholic beverages for on-premises
4040 consumption who does not hold a food and beverage certificate for
4141 the premises to display a sign on the door to each restroom on the
4242 license holder's premises that informs the public of:
4343 (1) the criminal penalties for a conviction of the
4444 offense of driving while intoxicated; and
4545 (2) the average costs a person convicted of driving
4646 while intoxicated can expect to pay, including attorney's fees,
4747 criminal fines, court costs, bail, driver's license surcharges, and
4848 alcohol education course fees.
4949 (b) The commission's rules shall specify the size and
