1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1212 Code, is amended by adding Chapter 3867 to read as follows:
1313 CHAPTER 3867. PEARLAND MUNICIPAL MANAGEMENT DISTRICT NO. 2
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 3867.001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "City" means the City of Pearland.
1818 (3) "County" means Brazoria County.
1919 (4) "Director" means a board member.
2020 (5) "District" means the Pearland Municipal
2121 Management District No. 2.
2222 Sec. 3867.002. NATURE OF DISTRICT. The Pearland Municipal
2323 Management District No. 2 is a special district created under
2424 Section 59, Article XVI, Texas Constitution.
2525 Sec. 3867.003. PURPOSE; DECLARATION OF INTENT. (a) The
2626 creation of the district is essential to accomplish the purposes of
2727 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
2828 Texas Constitution, and other public purposes stated in this
2929 chapter. By creating the district and in authorizing the city, the
3030 county, and other political subdivisions to contract with the
3131 district, the legislature has established a program to accomplish
3232 the public purposes set out in Section 52-a, Article III, Texas
3333 Constitution.
3434 (b) The creation of the district is necessary to promote,
3535 develop, encourage, and maintain employment, commerce,
3636 transportation, housing, tourism, recreation, the arts,
3737 entertainment, economic development, safety, and the public
3838 welfare in the district.
3939 (c) This chapter and the creation of the district may not be
4040 interpreted to relieve the city or the county from providing the
4141 level of services provided as of the effective date of the Act
4242 enacting this chapter to the area in the district. The district is
4343 created to supplement and not to supplant city or county services
4444 provided in the district.
4545 Sec. 3867.004. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4646 (a) The district is created to serve a public use and benefit.
4747 (b) All land and other property included in the district
4848 will benefit from the improvements and services to be provided by
4949 the district under powers conferred by Sections 52 and 52-a,
5050 Article III, and Section 59, Article XVI, Texas Constitution, and
5151 other powers granted under this chapter.
5252 (c) The creation of the district is in the public interest
5353 and is essential to further the public purposes of:
5454 (1) developing and diversifying the economy of the
5555 state;
5656 (2) eliminating unemployment and underemployment; and
5757 (3) developing or expanding transportation and
5858 commerce.
5959 (d) The district will:
6060 (1) promote the health, safety, and general welfare of
6161 residents, employers, potential employees, employees, visitors,
6262 and consumers in the district, and of the public;
6363 (2) provide needed funding for the district to
6464 preserve, maintain, and enhance the economic health and vitality of
6565 the district territory as a community and business center;
6666 (3) promote the health, safety, welfare, and enjoyment
6767 of the public by providing pedestrian ways and by landscaping and
6868 developing certain areas in the district, which are necessary for
6969 the restoration, preservation, and enhancement of scenic beauty;
7070 and
7171 (4) provide for street or road and recreational
7272 facilities and improvements, including related drainage
7373 facilities, for the district.
7474 (e) Pedestrian or other nonmotorized vehicle ways along or
7575 across a street, whether at grade or above or below the surface, and
7676 street lighting, street landscaping, parking, and street art
7777 objects are parts of and necessary components of a street and are
7878 considered to be a street or road improvement.
7979 (f) The district will not act as the agent or
8080 instrumentality of any private interest even though the district
8181 will benefit many private interests as well as the public.
8282 Sec. 3867.005. INITIAL DISTRICT TERRITORY. (a) The
8383 district is initially composed of the territory described by
8484 Section 2 of the Act enacting this chapter.
8585 (b) The boundaries and field notes contained in Section 2 of
8686 the Act enacting this chapter form a closure. A mistake in the
8787 field notes or in copying the field notes in the legislative process
8888 does not affect the district's:
8989 (1) organization, existence, or validity;
9090 (2) right to issue any type of bond for the purposes
9191 for which the district is created or to pay the principal of and
9292 interest on the bond;
9393 (3) right to impose or collect an assessment or tax; or
9494 (4) legality or operation.
9595 Sec. 3867.006. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
9696 All or any part of the area of the district is eligible to be
9797 included in:
9898 (1) a tax increment reinvestment zone created under
9999 Chapter 311, Tax Code;
100100 (2) a tax abatement reinvestment zone created under
101101 Chapter 312, Tax Code;
102102 (3) an enterprise zone created under Chapter 2303,
103103 Government Code; or
104104 (4) an industrial district created under Chapter 42,
105105 Local Government Code.
106106 Sec. 3867.007. APPLICABILITY OF MUNICIPAL MANAGEMENT
107107 DISTRICTS LAW. Except as otherwise provided by this chapter,
108108 Chapter 375, Local Government Code, applies to the district.
109109 Sec. 3867.008. CONSTRUCTION OF CHAPTER. This chapter shall
110110 be liberally construed in conformity with the findings and purposes
111111 stated in this chapter.
112112 SUBCHAPTER B. BOARD OF DIRECTORS
113113 Sec. 3867.051. GOVERNING BODY; TERMS. (a) The district is
114114 governed by a board of seven voting directors who serve staggered
115115 terms of four years, with three or four directors' terms expiring
116116 June 1 of each odd-numbered year.
117117 (b) The board by resolution may change the number of voting
118118 directors on the board if the board determines that the change is in
119119 the best interest of the district and the governing body of the city
120120 consents to the change. The board may not consist of fewer than 5 or
121121 more than 15 voting directors.
122122 Sec. 3867.052. APPOINTMENT OF VOTING DIRECTORS. The
123123 governing body of the city shall appoint voting directors from
124124 persons recommended by the board. A person is appointed if a
125125 majority of the members of the governing body of the city vote to
126126 appoint that person.
127127 Sec. 3867.053. NONVOTING DIRECTORS. The board may appoint
128128 nonvoting directors to serve at the pleasure of the voting
129129 directors.
130130 Sec. 3867.054. QUORUM. For purposes of determining the
131131 requirements for a quorum of the board, the following are not
132132 counted:
133133 (1) a board position vacant for any reason, including
134134 death, resignation, or disqualification;
135135 (2) a director who is abstaining from participation in
136136 a vote because of a conflict of interest; or
137137 (3) a nonvoting director.
138138 Sec. 3867.055. INITIAL VOTING DIRECTORS. (a) The initial
139139 board consists of the following voting directors:

158158 the terms of directors appointed for positions five through seven
159159 expire June 1, 2017.
160160 (c) Section 3867.052 does not apply to this section.
161161 (d) This section expires September 1, 2017.
162162 SUBCHAPTER C. POWERS AND DUTIES
163163 Sec. 3867.101. GENERAL POWERS AND DUTIES. The district has
164164 the powers and duties necessary to accomplish the purposes for
165165 which the district is created.
166166 Sec. 3867.102. IMPROVEMENT PROJECTS AND SERVICES. The
167167 district may provide, design, construct, acquire, improve,
168168 relocate, operate, maintain, or finance an improvement project or
169169 service using any money available to the district, or contract with
170170 a governmental or private entity to provide, design, construct,
171171 acquire, improve, relocate, operate, maintain, or finance an
172172 improvement project or service authorized under this chapter or
173173 Chapter 375, Local Government Code.
174174 Sec. 3867.103. DEVELOPMENT CORPORATION POWERS. The
175175 district, using money available to the district, may exercise the
176176 powers given to a development corporation under Chapter 505, Local
177177 Government Code, including the power to own, operate, acquire,
178178 construct, lease, improve, or maintain a project under that
179179 chapter.
180180 Sec. 3867.104. NONPROFIT CORPORATION. (a) The board by
181181 resolution may authorize the creation of a nonprofit corporation to
182182 assist and act for the district in implementing a project or
183183 providing a service authorized by this chapter.
184184 (b) The nonprofit corporation:
185185 (1) has each power of and is considered to be a local
186186 government corporation created under Subchapter D, Chapter 431,
187187 Transportation Code; and
188188 (2) may implement any project and provide any service
189189 authorized by this chapter.
190190 (c) The board shall appoint the board of directors of the
191191 nonprofit corporation. The board of directors of the nonprofit
192192 corporation shall serve in the same manner as the board of directors
193193 of a local government corporation created under Subchapter D,
194194 Chapter 431, Transportation Code, except that a board member is not
195195 required to reside in the district.
196196 Sec. 3867.105. AGREEMENTS; GRANTS. (a) As provided by
197197 Chapter 375, Local Government Code, the district may make an
198198 agreement with or accept a gift, grant, or loan from any person.
199199 (b) The implementation of a project is a governmental
200200 function or service for the purposes of Chapter 791, Government
201201 Code.
202202 Sec. 3867.106. LAW ENFORCEMENT AND SECURITY SERVICES. To
203203 protect the public interest, the district may provide security
204204 services or contract with a qualified party, including the county
205205 or the city, to provide law enforcement services in the district for
206206 a fee.
207207 Sec. 3867.107. MEMBERSHIP IN CHARITABLE ORGANIZATIONS. The
208208 district may join and pay dues to a charitable or nonprofit
209209 organization that performs a service or provides an activity
210210 consistent with the furtherance of a district purpose.
211211 Sec. 3867.108. ECONOMIC DEVELOPMENT. (a) The district may
212212 engage in activities that accomplish the economic development
213213 purposes of the district.
214214 (b) The district may establish and provide for the
215215 administration of one or more programs to promote state or local
216216 economic development and to stimulate business and commercial
217217 activity in the district, including programs to:
218218 (1) make loans and grants of public money; and
219219 (2) provide district personnel and services.
220220 (c) The district may create economic development programs
221221 and exercise the economic development powers provided to
222222 municipalities by:
223223 (1) Chapter 380, Local Government Code; and
224224 (2) Subchapter A, Chapter 1509, Government Code.
225225 Sec. 3867.109. PARKING FACILITIES. (a) The district may
226226 acquire, lease as lessor or lessee, construct, develop, own,
227227 operate, and maintain parking facilities or a system of parking
228228 facilities, including lots, garages, parking terminals, or other
229229 structures or accommodations for parking motor vehicles off the
230230 streets and related appurtenances.
231231 (b) The district's parking facilities serve the public
232232 purposes of the district and are owned, used, and held for a public
233233 purpose even if leased or operated by a private entity for a term of
234234 years.
235235 (c) The district's parking facilities are parts of and
236236 necessary components of a street and are considered to be a street
237237 or road improvement.
238238 (d) The development and operation of the district's parking
239239 facilities may be considered an economic development program.
240240 Sec. 3867.110. ANNEXATION OF LAND. The district may annex
241241 land as provided by Subchapter J, Chapter 49, Water Code.
242242 Sec. 3867.111. APPROVAL BY CITY. (a) Except as provided
243243 by Chapter 375, Local Government Code, the district must obtain the
244244 approval of the city for:
245245 (1) the issuance of bonds;
246246 (2) the annexation or exclusion of land;
247247 (3) the plans and specifications of an improvement
248248 project financed by bonds; and
249249 (4) the plans and specifications of an improvement
250250 project related to the use of land owned by the city, an easement
251251 granted by the city, or a right-of-way of a street, road, or
252252 highway.
253253 (b) The district may not issue bonds or annex or exclude
254254 land until the governing body of the city adopts a resolution or
255255 ordinance authorizing the issuance of the bonds or the annexation
256256 or exclusion of the land.
257257 (c) The governing body of the city:
258258 (1) is not required to adopt a resolution or ordinance
259259 to approve plans and specifications described by Subsection (a);
260260 and
261261 (2) may establish an administrative process to approve
262262 plans and specifications described by Subsection (a) without the
263263 involvement of the governing body.
264264 Sec. 3867.112. NO EMINENT DOMAIN POWER. The district may
265265 not exercise the power of eminent domain.
266266 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS; ASSESSMENTS
267267 Sec. 3867.151. DISBURSEMENTS AND TRANSFERS OF MONEY. The
268268 board by resolution shall establish the number of directors'
269269 signatures and the procedure required for a disbursement or
270270 transfer of district money.
271271 Sec. 3867.152. MONEY USED FOR IMPROVEMENTS OR SERVICES.
272272 The district may acquire, construct, finance, operate, or maintain
273273 any improvement or service authorized under this chapter or Chapter
274274 375, Local Government Code, using any money available to the
275275 district.
276276 Sec. 3867.153. PETITION REQUIRED FOR FINANCING SERVICES AND
277277 IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
278278 service or improvement project with assessments under this chapter
279279 unless a written petition requesting that service or improvement
280280 has been filed with the board.
281281 (b) A petition filed under Subsection (a) must be signed by
282282 the owners of a majority of the assessed value of real property in
283283 the district subject to assessment according to the most recent
284284 certified tax appraisal roll for the county.
285285 Sec. 3867.154. ASSESSMENTS; LIENS FOR ASSESSMENTS.
286286 (a) The board by resolution may impose and collect an assessment
287287 for any purpose authorized by this chapter in all or any part of the
288288 district.
289289 (b) An assessment, a reassessment, or an assessment
290290 resulting from an addition to or correction of the assessment roll
291291 by the district, penalties and interest on an assessment or
292292 reassessment, an expense of collection, and reasonable attorney's
293293 fees incurred by the district:
294294 (1) are a first and prior lien against the property
295295 assessed;
296296 (2) are superior to any other lien or claim other than
297297 a lien or claim for county, school district, or municipal ad valorem
298298 taxes; and
299299 (3) are the personal liability of and a charge against
300300 the owners of the property even if the owners are not named in the
301301 assessment proceedings.
302302 (c) The lien is effective from the date of the board's
303303 resolution imposing the assessment until the date the assessment is
304304 paid. The board may enforce the lien in the same manner that the
305305 board may enforce an ad valorem tax lien against real property.
306306 (d) The board may make a correction to or deletion from the
307307 assessment roll that does not increase the amount of assessment of
308308 any parcel of land without providing notice and holding a hearing in
309309 the manner required for additional assessments.
310310 Sec. 3867.155. TAX AND ASSESSMENT ABATEMENTS. The district
311311 may designate reinvestment zones and may grant abatements of a tax
312312 or assessment on property in the zones.
313313 SUBCHAPTER E. TAXES AND BONDS
314314 Sec. 3867.201. ELECTIONS REGARDING TAXES AND BONDS.
315315 (a) The district may issue, without an election, bonds, notes, and
316316 other obligations secured by:
317317 (1) revenue other than ad valorem taxes; or
318318 (2) contract payments described by Section 3867.203.
319319 (b) The district must hold an election in the manner
320320 provided by Subchapter L, Chapter 375, Local Government Code, to
321321 obtain voter approval before the district may impose an ad valorem
322322 tax or issue bonds payable from ad valorem taxes.
323323 (c) Section 375.243, Local Government Code, does not apply
324324 to the district.
325325 (d) All or any part of any facilities or improvements that
326326 may be acquired by a district by the issuance of its bonds may be
327327 submitted as a single proposition or as several propositions to be
328328 voted on at the election.
329329 Sec. 3867.202. OPERATION AND MAINTENANCE TAX. (a) If
330330 authorized by a majority of the district voters voting at an
331331 election held in accordance with Section 3867.201, the district may
332332 impose an operation and maintenance tax on taxable property in the
333333 district in accordance with Section 49.107, Water Code, for any
334334 district purpose, including to:
335335 (1) maintain and operate the district;
336336 (2) construct or acquire improvements; or
337337 (3) provide a service.
338338 (b) The board shall determine the tax rate. The rate may not
339339 exceed the rate approved at the election.
340340 Sec. 3867.203. CONTRACT TAXES. (a) In accordance with
341341 Section 49.108, Water Code, the district may impose a tax other than
342342 an operation and maintenance tax and use the revenue derived from
343343 the tax to make payments under a contract after the provisions of
344344 the contract have been approved by a majority of the district voters
345345 voting at an election held for that purpose.
346346 (b) A contract approved by the district voters may contain a
347347 provision stating that the contract may be modified or amended by
348348 the board without further voter approval.
349349 Sec. 3867.204. AUTHORITY TO BORROW MONEY AND TO ISSUE BONDS
350350 AND OTHER OBLIGATIONS. (a) The district may borrow money on terms
351351 determined by the board. Section 375.205, Local Government Code,
352352 does not apply to a loan, line of credit, or other borrowing from a
353353 bank or financial institution secured by revenue other than ad
354354 valorem taxes.
355355 (b) The district may issue bonds, notes, or other
356356 obligations payable wholly or partly from ad valorem taxes,
357357 assessments, impact fees, revenue, contract payments, grants, or
358358 other district money, or any combination of those sources of money,
359359 to pay for any authorized district purpose.
360360 Sec. 3867.205. TAXES FOR BONDS. At the time the district
361361 issues bonds payable wholly or partly from ad valorem taxes, the
362362 board shall provide for the annual imposition of a continuing
363363 direct annual ad valorem tax, without limit as to rate or amount,
364364 for each year that all or part of the bonds are outstanding as
365365 required and in the manner provided by Sections 54.601 and 54.602,
366366 Water Code.
367367 Sec. 3867.206. TAXES AND BONDS FOR RECREATIONAL FACILITIES.
368368 (a) The limitation on the outstanding principal amount of bonds,
369369 notes, and other obligations provided by Section 49.4645, Water
370370 Code, does not apply to the district.
371371 (b) Section 49.107(h), Water Code, does not apply to the
372372 district.
373373 Sec. 3867.207. CITY NOT REQUIRED TO PAY DISTRICT
374374 OBLIGATIONS. Except as provided by Section 375.263, Local
375375 Government Code, the city is not required to pay a bond, note, or
376376 other obligation of the district.
377377 SECTION 2. The Pearland Municipal Management District No. 2
378378 initially includes all territory contained in the following area:
379379 BEING 1,483 acres, more or less, of land within the City
380380 Limits of Pearland, Texas, located in the H. T. & B. R. R. Co.
381381 Survey, Abstract No. 300, the J. W. Maxcy Survey, Abstract No. 675,
382382 the R. B. Lyle Survey, Abstract No. 539, the W. W. Dupuy and L. F.
383383 Roberts Survey, Abstract No. 726, the H. T. & B. R. R. Co. Survey,
384384 Abstract No. 304, the W. M. Morris Survey, Abstract No. 344, the J.
385385 Crawley Survey, Abstract No.174 and the D. White Survey, Abstract
386386 No. 747, Brazoria County, Texas and also located in the James
387387 Hamilton Survey, Abstract No. 881, Harris County, Texas, said 1,483
388388 acres being more particularly described as follows:
389389 BEGINNING at the southeast corner of SOUTHGATE SECTION ONE, a
390390 subdivision of record in Volume 24, Pages 123-126 of the Plat
391391 Records of Brazoria County, Texas (B.C.P.R.) on the northerly
392392 right-of-way line of County Road 59 (width varies);
393393 THENCE NORTHERLY, 2,574 feet more or less, along the east
394394 line of said SOUTHGATE SECTION ONE and the east line of SOUTHGATE
395395 SECTION TWO, a subdivision of record in Volume 24, Pages 278-279,
396396 B.C.P.R. to the northeast corner of said SOUTHGATE SECTION TWO;
397397 THENCE WESTERLY, 2,642 feet more or less, along the north
398398 line of said SOUTHGATE SECTION TWO to a point on the west line of
399399 said SOUTHGATE SECTION ONE for the southwest corner of Restricted
400400 Reserve "A" of said SOUTHGATE SECTION ONE;
401401 THENCE NORTHERLY, 1,175 feet more or less, along said west
402402 line to the southwest corner of the MINOR PLAT OF KIRBY WATER PLANT
403403 SITE AND FIRE STATION NO. 5, a subdivision of record under Document
404404 Number 2008029867 of the Official Public Records of Brazoria
405405 County, Texas (B.C.O.P.R.)
406406 THENCE EASTERLY, 626 feet more or less, to the southeast
407407 corner of said MINOR PLAT;
408408 THENCE NORTHEASTERLY, 335 feet more or less, to the northeast
409409 corner of said MINOR PLAT;
410410 THENCE WESTERLY, 776 feet more or less, to the northwest
411411 corner of said MINOR PLAT and being the southwest corner of the
412412 remainder of a called 13.380 acre tract of land conveyed to Pearland

416416 THENCE NORTHERLY, 1,231 feet more or less, along the west
417417 line of said remainder and the west line of KIRBY CROSSING SECTION

419419 B.C.O.R., to the south right-of-way line and crossing to the north
420420 right-of-way line of F.M. 518 (120' wide);
421421 THENCE WESTERLY, 597 feet more or less, along said north
422422 right-of-way line to the southeast corner of SF-18B, a subdivision
423423 of record in Volume 23, Pages 393-396, B.C.P.R.;
424424 THENCE NORTHERLY, 1,053 feet more or less, along the east
425425 line of said SF-18B to the south line of SF-15, a subdivision of

652652 introduce this Act, setting forth the general substance of this
653653 Act, has been published as provided by law, and the notice and a
654654 copy of this Act have been furnished to all persons, agencies,
655655 officials, or entities to which they are required to be furnished
656656 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
657657 Government Code.
658658 (b) The governor, one of the required recipients, has
659659 submitted the notice and Act to the Texas Commission on
660660 Environmental Quality.
661661 (c) The Texas Commission on Environmental Quality has filed
662662 its recommendations relating to this Act with the governor,
663663 lieutenant governor, and speaker of the house of representatives
664664 within the required time.
665665 (d) The general law relating to consent by political
666666 subdivisions to the creation of districts with conservation,
667667 reclamation, and road powers and the inclusion of land in those
668668 districts has been complied with.
669669 (e) All requirements of the constitution and laws of this
670670 state and the rules and procedures of the legislature with respect
671671 to the notice, introduction, and passage of this Act have been
672672 fulfilled and accomplished.
673673 SECTION 4. This Act takes effect immediately if it receives
674674 a vote of two-thirds of all the members elected to each house, as
675675 provided by Section 39, Article III, Texas Constitution. If this
676676 Act does not receive the vote necessary for immediate effect, this
677677 Act takes effect September 1, 2013.
