88 relating to county expenditures for certain health care services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 61.036, Health and Safety Code, is
1111 amended by adding Subsections (d) and (e) to read as follows:
1212 (d) Regardless of the application, documentation, and
1313 verification procedures or eligibility standards established by
1414 the department under Subchapter A, a county may credit an
1515 intergovernmental transfer to the state toward eligibility for
1616 state assistance if the transfer was made to provide health care
1717 services as part of the Texas Healthcare Transformation and Quality
1818 Improvement Program waiver issued under 42 U.S.C. Section 1315.
1919 (e) A county may credit toward eligibility for state
2020 assistance intergovernmental transfers made under Subsection (d)
2121 that in the aggregate do not exceed four percent of the county's
2222 general revenue levy in any state fiscal year, provided:
2323 (1) The commissioners court determines that the
2424 expenditure fulfills the county's obligations to provide indigent
2525 health care under this chapter;
2626 (2) The commissioners court determines that the amount
2727 of care available through participation in the waiver is sufficient
2828 in type and amount to meet the requirements of this chapter; and
2929 (3) The county receives periodic reports from health
3030 care providers that receive supplemental or incentive payments
3131 under the Texas Healthcare Transformation and Quality Improvement
3232 Program waiver that document the number and types of services
3333 provided to persons who are eligible to receive services under this
3434 chapter.
3535 SECTION 2. Not later than December 1, 2014, the Department
3636 of State Health Services shall submit a report to the governor, the
3737 lieutenant governor, and the speaker of the house of
3838 representatives on the effects of the provisions of this Act on
3939 services rendered to eligible residents under Chapter 61, Health
4040 and Safety Code.
4141 SECTION 3. (a) The change in law made by this Act to Section
4242 61.036, Health and Safety Code, applies only to state assistance
4343 for health care services under Chapter 61, Health and Safety Code,
4444 as amended by this Act, that are delivered on or after the effective
4545 date of this Act.
4646 (b) State assistance for health care services under
4747 Chapter
4848 61, Health and Safety Code, that are delivered before the effective
4949 date of this Act is governed by the law as it existed immediately
5050 before the effective date of this Act, and that law is continued in
5151 effect for that purpose.
5252 SECTION 4. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2013.
