| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Section 36.117, Water Code, is amended by adding |
|---|
| 16 | 16 | | Subsection (a-1) to read as follows: |
|---|
| 17 | 17 | | (a-1) The district may not provide an exemption to the |
|---|
| 18 | 18 | | district's requirement to obtain a permit for a water well used to |
|---|
| 19 | 19 | | supply water for: |
|---|
| 20 | 20 | | (1) the performance of a hydraulic fracturing |
|---|
| 21 | 21 | | treatment on an oil or gas well; or |
|---|
| 22 | 22 | | (2) other activities related to the production of oil |
|---|
| 23 | 23 | | or gas from a completed oil or gas well. |
|---|
| 24 | 24 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 25 | 25 | | to a well for which drilling is commenced on or after the effective |
|---|
| 26 | 26 | | date of this Act. A well for which drilling is commenced before the |
|---|
| 27 | 27 | | effective date of this Act is subject to the law in effect |
|---|
| 28 | 28 | | immediately before that date, and that law is continued in effect |
|---|
| 29 | 29 | | for that purpose. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2013. |
