99 AN ACT
1010 relating to the authority of a groundwater conservation district to
1111 require a permit for the drilling or operation of a water well used
1212 to supply water for the performance of a hydraulic fracturing
1313 treatment on an oil or gas well.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 36.117, Water Code, is amended by adding
1616 Subsection (a-1) to read as follows:
1717 (a-1) The district may not provide an exemption to the
1818 district's requirement to obtain a permit for a water well used to
1919 supply water for:
2020 (1) the performance of a hydraulic fracturing
2121 treatment on an oil or gas well; or
2222 (2) other activities related to the production of oil
2323 or gas from a completed oil or gas well.
2424 SECTION 2. The change in law made by this Act applies only
2525 to a well for which drilling is commenced on or after the effective
2626 date of this Act. A well for which drilling is commenced before the
2727 effective date of this Act is subject to the law in effect
2828 immediately before that date, and that law is continued in effect
2929 for that purpose.
3030 SECTION 3. This Act takes effect September 1, 2013.
