77 relating to quorums and meetings by teleconference of the Texas
88 Bioenergy Policy Council and the Texas Bioenergy Research
99 Committee.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subsection (e), Section 50D.011, Agriculture
1212 Code, is amended to read as follows:
1313 (e) Subject to Section 50D.017, the [The] policy council is
1414 subject to Chapters 551 and 2001, Government Code.
1515 SECTION 2. Subchapter B, Chapter 50D, Agriculture Code, is
1616 amended by adding Sections 50D.016 and 50D.017 to read as follows:
1717 Sec. 50D.016. QUORUM. A quorum of the policy council
1818 consists of not less than half of the members of the policy council.
1919 A member who participates in a meeting by telephone conference
2020 call, videoconference, or other similar telecommunication method
2121 may be counted to establish a quorum.
2222 Sec. 50D.017. MEETING BY TELECONFERENCE.
2323 (a) Notwithstanding Chapter 551, Government Code, or any other
2424 law, the policy council may hold an open or closed meeting by
2525 telephone conference call, videoconference, or other similar
2626 telecommunication method if:
2727 (1) notice is given for the meeting as for other
2828 meetings;
2929 (2) the notice specifies a location for the meeting at
3030 which the public may attend;
3131 (3) each part of the meeting that is required to be
3232 open to the public is audible to the public at the location
3333 specified in the notice of the meeting; and
3434 (4) the meeting is recorded by electronic or other
3535 means and the recording of each portion of the meeting that is
3636 required to be open to the public is made available to the public.
3737 (b) A member of the policy council may participate by
3838 telephone conference call, videoconference, or other similar
3939 telecommunication method in a policy council meeting at which other
4040 members are physically present and may vote.
4141 SECTION 3. Subsection (e), Section 50D.021, Agriculture
4242 Code, is amended to read as follows:
4343 (e) Subject to Section 50D.026, [The] research committee is
4444 subject to Chapters 551 and 2001, Government Code.
4545 SECTION 4. Subchapter C, Chapter 50D, Agriculture Code, is
4646 amended by adding Sections 50D.025 and 50D.026 to read as follows:
4747 Sec. 50D.025. QUORUM. A quorum of the research committee
4848 consists of not less than half of the members of the research
4949 committee. A member who participates in a meeting by telephone
5050 conference call, videoconference, or other similar
5151 telecommunication method may be counted to establish a quorum.
5252 Sec. 50D.026. MEETING BY TELECONFERENCE.
5353 (a) Notwithstanding Chapter 551, Government Code, or any other
5454 law, the research committee may hold an open or closed meeting by
5555 telephone conference call, videoconference, or other similar
5656 telecommunication method if:
5757 (1) notice is given for the meeting as for other
5858 meetings;
5959 (2) the notice specifies a location for the meeting at
6060 which the public may attend;
6161 (3) each part of the meeting that is required to be
6262 open to the public is audible to the public at the location
6363 specified in the notice of the meeting; and
6464 (4) the meeting is recorded by electronic or other
6565 means and the recording of each portion of the meeting that is
6666 required to be open to the public is made available to the public.
6767 (b) A member of the research committee may participate by
6868 telephone conference call, videoconference, or other similar
6969 telecommunication method in a research committee meeting at which
7070 other members are physically present and may vote.
7171 SECTION 5. This Act takes effect immediately if it receives
7272 a vote of two-thirds of all the members elected to each house, as
7373 provided by Section 39, Article III, Texas Constitution. If this
7474 Act does not receive the vote necessary for immediate effect, this
7575 Act takes effect September 1, 2013.
