1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to equal opportunity for access by home-schooled students
1313 to University Interscholastic League-sponsored activities;
1414 authorizing a fee.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1717 amended by adding Section 33.0833 to read as follows:
1818 Sec. 33.0833. EQUAL OPPORTUNITY FOR HOME-SCHOOLED STUDENTS
1919 TO PARTICIPATE IN UNIVERSITY INTERSCHOLASTIC LEAGUE ACTIVITIES.
2020 (a) In this section, "home-schooled student" has the meaning
2121 assigned by Section 29.916.
2222 (b) Except as provided by Subsection (g), a public school
2323 that participates in an activity sponsored by the University
2424 Interscholastic League shall provide a home-schooled student, who
2525 otherwise meets league eligibility standards to represent that
2626 school in a league activity, with the opportunity to participate in
2727 the activity on behalf of the school in the same manner that the
2828 school provides the opportunity to participate to students enrolled
2929 in the school.
3030 (c) A home-schooled student who seeks to participate or who
3131 participates in a league activity on behalf of a school is subject
3232 to the relevant policies that apply to students enrolled in the
3333 school, including policies regarding registration, age
3434 eligibility, fees, insurance, transportation, physical condition,
3535 qualifications, responsibilities, event schedules, standards of
3636 behavior, and performance.
3737 (d) The parent or legal guardian of a home-schooled student
3838 is responsible for oversight of academic standards relating to the
3939 student's participation in a league activity. As a condition of
4040 eligibility to participate in a league activity during the first
4141 six weeks of a school year, a home-schooled student must
4242 demonstrate grade-level academic proficiency on any nationally
4343 recognized, norm-referenced assessment instrument, including the
4444 Iowa Test of Basic Skills, Stanford Achievement Test, California
4545 Achievement Test, and Comprehensive Test of Basic Skills. A
4646 home-schooled student demonstrates the required academic
4747 proficiency by achieving a composite, core, or survey score that is
4848 within the average or higher than average range of scores, as
4949 established by the applicable testing service. For purposes of
5050 this subsection, a school district shall accept assessment results
5151 administered or reported by a third party.
5252 (e) A home-schooled student's demonstration of academic
5353 proficiency under Subsection (d) is sufficient for purposes of that
5454 subsection for the school year in which the student achieves the
5555 required score and the subsequent school year.
5656 (f) After the first six weeks of a school year, the parent or
5757 legal guardian of a home-schooled student participating in a league
5858 activity on behalf of a public school must periodically, in
5959 accordance with the school's grading calendar, provide written
6060 verification to the school indicating that the student is receiving
6161 a passing grade in each course or subject being taught.
6262 (g) A home-schooled student is not authorized by this
6363 section to participate in a league activity during the remainder of
6464 any school year during which the student was previously enrolled in
6565 a public school.
6666 (h) The University Interscholastic League may not prohibit
6767 a home-schooled student from participating in league activities in
6868 the manner authorized by this section.
6969 (i) This section expires July 1, 2017.
7070 SECTION 2. Effective July 1, 2017, Subchapter D, Chapter
7171 33, Education Code, is amended by adding Section 33.0834 to read as
7272 follows:
7373 Sec. 33.0834. EQUAL OPPORTUNITY FOR HOME-SCHOOLED STUDENTS
7474 TO PARTICIPATE IN UNIVERSITY INTERSCHOLASTIC LEAGUE ACTIVITIES.
7575 (a) In this section, "home-schooled student" has the meaning
7676 assigned by Section 29.916.
7777 (b) Notwithstanding the expiration of Section 33.0833, as
7878 added by S.B. 929, Acts of the 83rd Legislature, Regular Session,
7979 2013, a home-schooled student who participated in an activity
8080 sponsored by the University Interscholastic League under the
8181 authority of that section before July 1, 2017, may continue to
8282 participate in the same league activity on the same terms
8383 previously specified by that section.
8484 (c) This section expires July 1, 2030.
8585 SECTION 3. This Act applies beginning with the 2013-2014
8686 school year.
8787 SECTION 4. Except as otherwise provided by this Act:
8888 (1) this Act takes effect immediately if it receives a
8989 vote of two-thirds of all the members elected to each house, as
9090 provided by Section 39, Article III, Texas Constitution; and
9191 (2) if this Act does not receive the vote necessary for
9292 immediate effect, this Act takes effect September 1, 2013.
