9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 30.02, Penal Code, is amended by adding | |
11 | 11 | Subsection (e) to read as follows: | |
12 | 12 | (e) It is not a defense to prosecution under this section | |
13 | 13 | that the actor is attempting to take ownership of the real property | |
14 | 14 | through adverse possession or a claim of adverse possession unless | |
15 | 15 | the actor has full title subject to Section 16.030, Civil Practice | |
16 | 16 | and Remedies Code. | |
17 | 17 | SECTION 2. The changes in law made by this Act apply only to | |
18 | 18 | an offense committed on or after the effective date of this Act. An | |
19 | 19 | offense committed before the effective date of this Act is governed | |
20 | 20 | by the law in effect when the offense was committed, and the former | |
21 | 21 | law is continued in effect for that purpose. For purposes of this | |
22 | 22 | section, an offense was committed before the effective date of this | |
23 | 23 | Act if any element of the offense occurred before that date. | |
24 | 24 | SECTION 3. This Act takes effect September 1, 2013. |
