9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 18, Code of Criminal Procedure, is | |
11 | 11 | amended by adding Article 18.065 to read as follows: | |
12 | 12 | Art. 18.065. WARRANT FOR DNA SPECIMEN MAY BE EXECUTED IN ANY | |
13 | 13 | COUNTY. Notwithstanding any other law, a warrant issued under | |
14 | 14 | Article 18.02(10) to collect a DNA specimen from a person for the | |
15 | 15 | purpose of connecting that person to an offense may be executed in | |
16 | 16 | any county in this state, regardless of whether the issuing court's | |
17 | 17 | jurisdiction extends outside the county in which that court is | |
18 | 18 | located. | |
19 | 19 | SECTION 2. The change in law made by this Act applies only | |
20 | 20 | to a search warrant issued on or after the effective date of this | |
21 | 21 | Act. A search warrant issued before the effective date of this Act | |
22 | 22 | is governed by the law in effect on the date the warrant was issued, | |
23 | 23 | and the former law is continued in effect for that purpose. | |
24 | 24 | SECTION 3. This Act takes effect September 1, 2013. |
