88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article IV, Texas Constitution, is amended by
1010 adding Section 2a to read as follows:
1111 Sec. 2a. (a) A person who has been elected or appointed to
1212 serve two consecutive terms in an office listed in Section 1 of this
1313 article or any other state office normally filled by the voters at a
1414 statewide election, other than a statewide judicial office, is not
1515 eligible for election or appointment to serve a third consecutive
1616 term. This provision does not limit a person's eligibility for
1717 election or appointment to serve nonconsecutive terms.
1818 (b) Nothing in this section prohibits a person from
1919 continuing to serve in an office covered by this section after the
2020 end of a term as a holdover under Section 17, Article XVI, of this
2121 constitution until a successor is qualified.
2222 (c) The term of a person appointed to serve for the
2323 remainder of a term to fill a vacancy in a statewide office is not
2424 counted in determining whether a person is eligible to serve under
2525 Subsection (a) of this section.
2626 SECTION 2. The following temporary provision is added to
2727 the Texas Constitution:
2828 TEMPORARY PROVISION. (a) This temporary provision applies
2929 to the constitutional amendment proposed by the 83rd Legislature,
3030 Regular Session, 2013, limiting to two the number of consecutive
3131 terms for which a person may be elected or appointed to hold certain
3232 state offices.
3333 (b) A term of office that begins before January 1, 2014, is
3434 not counted in determining whether a person is eligible to serve
3535 under Section 2a, Article IV, of this constitution.
3636 (c) This temporary provision expires February 1, 2031.
3737 SECTION 3. This proposed constitutional amendment shall be
3838 submitted to the voters at an election to be held November 5, 2013.
3939 The ballot shall be printed to permit voting for or against the
4040 proposition: "The constitutional amendment limiting to two the
4141 number of consecutive terms for which a person may be elected or
4242 appointed to hold the office of governor, lieutenant governor,
4343 secretary of state, comptroller of public accounts, commissioner of
4444 the General Land Office, attorney general, commissioner of
4545 agriculture, or railroad commissioner."
