55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the composition of districts for the election of
88 members of the Texas Senate.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The interim redistricting plan used to elect
1111 members of the Texas Senate in 2012 ordered by the United States
1212 District Court for the Western District of Texas on February 28,
1313 2012, in the case of Davis, et al. v. Perry, et al. (No.
1414 SA-11-CV-788), and identified as PLANS172 on the redistricting
1515 computer system operated by the Texas Legislative Council, is
1616 hereby ratified and adopted as the permanent plan for districts
1717 used to elect members of the Texas Senate.
1818 SECTION 2. In making this enactment the legislature finds
1919 that:
2020 (1) the United States District Court for the Western
2121 District of Texas properly applied the decision of the United
2222 States Supreme Court on January 20, 2012, in Perry, et al. v. Perez,
2323 et al., 565 U.S. ____ (2012) (per curiam), in the creation of the
2424 district court's interim plan for Texas Senate districts for use in
2525 the 2012 elections;
2626 (2) the district court's interim plan for Texas Senate
2727 districts complies with all federal and state constitutional
2828 provisions or laws applicable to redistricting plans, including the
2929 federal Voting Rights Act; and
3030 (3) the adoption of the district court's interim plan
3131 for Texas Senate districts as a permanent plan by the Texas
3232 Legislature will:
3333 (A) diminish the expense of further time and
3434 money by all parties in Texas' ongoing redistricting litigation;
3535 (B) avoid disruption of the upcoming election
3636 cycle; and
3737 (C) provide certainty and continuity to the
3838 citizens of Texas regarding the districts used to elect members of
3939 the Texas Senate.
4040 SECTION 3. Chapter 1315 (S.B. 31), Acts of the 82nd
4141 Legislature, Regular Session, 2011 (Article 193e, Vernon's Texas
4242 Civil Statutes), is repealed.
4343 SECTION 4. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect on the 91st day after the last day of the
4848 legislative session.
