7 | 7 | | relating to the composition of districts for the election of |
---|
8 | 8 | | members of the Texas Senate. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. The interim redistricting plan used to elect |
---|
11 | 11 | | members of the Texas Senate in 2012 ordered by the United States |
---|
12 | 12 | | District Court for the Western District of Texas on February 28, |
---|
13 | 13 | | 2012, in the case of Davis, et al. v. Perry, et al. (No. |
---|
14 | 14 | | SA-11-CV-788), and identified as PLANS172 on the redistricting |
---|
15 | 15 | | computer system operated by the Texas Legislative Council, is |
---|
16 | 16 | | hereby ratified and adopted as the permanent plan for districts |
---|
17 | 17 | | used to elect members of the Texas Senate. |
---|
18 | 18 | | SECTION 2. In making this enactment the legislature finds |
---|
19 | 19 | | that: |
---|
20 | 20 | | (1) the United States District Court for the Western |
---|
21 | 21 | | District of Texas properly applied the decision of the United |
---|
22 | 22 | | States Supreme Court on January 20, 2012, in Perry, et al. v. Perez, |
---|
23 | 23 | | et al., 565 U.S. ____ (2012) (per curiam), in the creation of the |
---|
24 | 24 | | district court's interim plan for Texas Senate districts for use in |
---|
25 | 25 | | the 2012 elections; |
---|
26 | 26 | | (2) the district court's interim plan for Texas Senate |
---|
27 | 27 | | districts complies with all federal and state constitutional |
---|
28 | 28 | | provisions or laws applicable to redistricting plans, including the |
---|
29 | 29 | | federal Voting Rights Act; and |
---|
30 | 30 | | (3) the adoption of the district court's interim plan |
---|
31 | 31 | | for Texas Senate districts as a permanent plan by the Texas |
---|
32 | 32 | | Legislature will: |
---|
33 | 33 | | (A) diminish the expense of further time and |
---|
34 | 34 | | money by all parties in Texas' ongoing redistricting litigation; |
---|
35 | 35 | | (B) avoid disruption of the upcoming election |
---|
36 | 36 | | cycle; and |
---|
37 | 37 | | (C) provide certainty and continuity to the |
---|
38 | 38 | | citizens of Texas regarding the districts used to elect members of |
---|
39 | 39 | | the Texas Senate. |
---|
40 | 40 | | SECTION 3. Chapter 1315 (S.B. 31), Acts of the 82nd |
---|
41 | 41 | | Legislature, Regular Session, 2011 (Article 193e, Vernon's Texas |
---|
42 | 42 | | Civil Statutes), is repealed. |
---|
43 | 43 | | SECTION 4. This Act takes effect immediately if it receives |
---|
44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
---|
45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
---|
47 | 47 | | Act takes effect on the 91st day after the last day of the |
---|
48 | 48 | | legislative session. |
