1010 relating to minimum standards for abortion facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subsection (a), Section 245.010, Health and
1313 Safety Code, is amended to read as follows:
1414 (a) The rules must contain minimum standards to protect the
1515 health and safety of a patient of an abortion facility and must
1616 contain provisions requiring compliance with the requirements of
1717 Subchapter B, Chapter 171. On and after September 1, 2014, the
1818 minimum standards for an abortion facility must be equivalent to
1919 the minimum standards adopted under Section 243.010 for ambulatory
2020 surgical centers.
2121 SECTION 2. Effective September 1, 2014, Subsection (c),
2222 Section 245.010, Health and Safety Code, is repealed.
2323 SECTION 3. (a) The executive commissioner of the Health
2424 and Human Services Commission shall adopt the standards required by
2525 Section 245.010, Health and Safety Code, as amended by this Act, not
2626 later than January 1, 2014.
2727 (b) A facility licensed under Chapter 245, Health and Safety
2828 Code, is not required to comply with the standards adopted under
2929 Section 245.010, Health and Safety Code, as amended by this Act,
3030 before September 1, 2014.
3131 SECTION 4. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect on the 91st day after the last day of the
3636 legislative session.
