By: Howard H.C.R. No. 15 HOUSE CONCURRENT RESOLUTION WHEREAS, Financing for transportation infrastructure projects is essential to the promotion of long-term economic growth in Texas; and WHEREAS, House Bill 16, 83rd Legislature, 2nd Called Session, 2013, or similar legislation makes appropriations for the purpose of financing transportation infrastructure projects; and WHEREAS, Appropriations made by House Bill 16 are separate from and in addition to appropriations made by the general appropriations bill, Senate Bill 1, 83rd Legislature, Regular Session, 2013; and WHEREAS, Appropriations made by the general appropriations bill are subject to the constitutional spending limit for state tax revenues not dedicated by the constitution, and appropriations made from those sources in Senate Bill 1 are less than the amount authorized by Section 22(a), Article VIII, Texas Constitution; now, therefore, be it RESOLVED, That the 83rd Legislature of the State of Texas, 2nd Called Session, finds that the existing need for financing transportation infrastructure projects constitutes an emergency for the people of Texas; and, be it further RESOLVED, That the 83rd Legislature may appropriate state tax revenues not dedicated by the Texas Constitution in excess of the amount authorized by Section 22(a), Article VIII, Texas Constitution, for the state fiscal biennium ending August 31, 2015, in an amount not to exceed the sum of the following amounts: (1) the amount of money equal to the amount by which transfers to the economic stabilization fund during the state fiscal year ending August 31, 2013, exceed the estimated amount of transfers to be made to that fund during that fiscal year as contained in the biennial state taxes and fees general revenue estimate for the state fiscal biennium ending August 31, 2013; and (2) the amount of money equal to the amount by which transfers to the economic stabilization fund during the state fiscal year ending August 31, 2014, exceed the estimated amount of transfers to be made to that fund during that fiscal year as contained in the biennial state taxes and fees general revenue estimate for the state fiscal biennium ending August 31, 2015. Authorizing the 83rd Legislature to appropriate an amount that exceeds the amount authorized by Section 22(a), Article VIII, Texas Constitution.
