9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Article 37.05, Code of Criminal Procedure, is |
---|
11 | 11 | | amended to read as follows: |

12 | 12 | | Art. 37.05. POLLING THE JURY. (a) The State and [or] the |
---|
13 | 13 | | defendant each [shall] have the right to have the jury polled, which |
---|
14 | 14 | | is done by calling separately the name or identification number of |
---|
15 | 15 | | each juror and asking him if the verdict is his. If all jurors, when |
---|
16 | 16 | | asked, answer in the affirmative, the verdict shall be entered upon |
---|
17 | 17 | | the minutes; but if any juror answers [answer] in the negative, the |
---|
18 | 18 | | jury shall retire again to consider its verdict. |
---|
19 | 19 | | (b) For the purposes of polling the jury in Subsection (a), |
---|
20 | 20 | | the judge may assign each juror an identification number to use in |
---|
21 | 21 | | place of the juror's name. |
---|
22 | 22 | | SECTION 2. This Act takes effect September 1, 2015. |
