10	4		AN ACT
11	5		relating to the designation of certain river or stream segments as
12	6		being of unique ecological value.
13	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	8		SECTION 1. DEFINITION. In this Act, "Region L" means
15	9		Regional Water Planning Area L designated in accordance with
16	10		Section 16.053, Water Code, as the area's boundaries existed on
17	11		September 1, 2015.
18	12		SECTION 2. DESIGNATION OF RIVER OR STREAM SEGMENTS OF
19	13		UNIQUE ECOLOGICAL VALUE. The legislature, as authorized by Section
20	14		16.051(f), Water Code, designates as being of unique ecological
21	15		value the following river or stream segments:
22	16		(1) the Nueces River from the northern boundary of
23	17		Region L to United States Geological Survey gauge number 08190000;
24	18		(2) the Frio River from the northern boundary of
25	19		Region L to United States Geological Survey gauge number 08195000;
26	20		(3) the Sabinal River from the northern boundary of
27	21		Region L to its intersection with State Highway 187;
28	22		(4) the San Marcos River from a point 0.4 miles
29	23		upstream from its intersection with State Highway Loop 82 to its
30	24		intersection with Interstate Highway 35; and
31	25		(5) the Comal River from its intersection with East
32	26		Klingemann Street in New Braunfels to its confluence with the
33	27		Guadalupe River.
34	28		SECTION 3. EFFECT OF DESIGNATION. The designation of a
35	29		river or stream segment as being of unique ecological value under
36	30		Section 2 of this Act:
37	31		(1) means only that a state agency or political
38	32		subdivision of the state may not finance the actual construction of
39	33		a reservoir in the designated segment;
40	34		(2) does not affect the ability of a state agency or
41	35		political subdivision of the state to construct, operate, maintain,
42	36		or replace a weir, a water diversion, flood control, drainage, or
43	37		water supply system, a low water crossing, or a recreational
44	38		facility in the designated segment;
45	39		(3) does not prohibit the permitting, financing,
46	40		construction, operation, maintenance, or replacement of any water
47	41		management strategy to meet projected water supply needs
48	42		recommended in, or designated as an alternative in, the 2011 or 2016
49	43		Regional Water Plan for Region L; and
50	44		(4) does not alter any existing property right of an
51	45		affected landowner.
52	46		SECTION 4. EFFECTIVE DATE. This Act takes effect September
53	47		1, 2015.
