55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prohibition of certain alcoholic beverages;
88 creating an offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1.04(4), Alcoholic Beverage Code, is
1111 amended to read as follows:
1212 (4) "Illicit beverage" means:
1313 (A) an alcoholic beverage:
1414 (i) [(A)] manufactured, distributed,
1515 bought, sold, bottled, rectified, blended, treated, fortified,
1616 mixed, processed, warehoused, stored, possessed, imported, or
1717 transported in violation of this code;
1818 (ii) [(B)] on which a tax imposed by the
1919 laws of this state has not been paid and to which the tax stamp, if
2020 required, has not been affixed; or
2121 (iii) [(C)] possessed, kept, stored, owned,
2222 or imported with intent to manufacture, sell, distribute, bottle,
2323 rectify, blend, treat, fortify, mix, process, warehouse, store, or
2424 transport in violation of this code; or
2525 (B) powdered alcohol.
2626 SECTION 2. Section 101.65, Alcoholic Beverage Code, is
2727 amended to read as follows:
2828 Sec. 101.65. BEVERAGES MADE FROM CERTAIN MATERIALS
2929 PROHIBITED. No person may manufacture, import, sell, serve, or
3030 possess for the purpose of sale an alcoholic beverage made from:
3131 (1) any compound made from synthetic materials;
3232 (2) substandard wines;
3333 (3) imitation wines; [or]
3434 (4) must concentrated at any time to more than 80
3535 degrees Balling; or
3636 (5) powdered alcohol, whether alone or reconstituted.
3737 SECTION 3. This Act takes effect September 1, 2015.
