125 relating to liability of food donors.
136 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
147 SECTION 1. Sections 76.004(a) and (c), Civil Practice and
158 Remedies Code, are amended to read as follows:
169 (a) A person or gleaner is not subject to civil or criminal
1710 liability arising from the condition of apparently wholesome food
1811 that the person or gleaner donates to a church, a not-for-profit
1912 organization or a nonprofit organization for distribution to the
2013 needy, if the food is apparently wholesome at the time of donation.
2114 This subsection does not apply to an injury or death that results
2215 from an act or omission of the donor constituting gross negligence,
2316 recklessness, or intentional misconduct.
2417 (c) A nonprofit organization is not subject to civil or
2518 criminal liability arising from the condition of apparently
2619 wholesome food that it distributes to the needy at no charge in
2720 substantial compliance with applicable local, county, state, and
2821 federal laws and rules regarding the storage and handling of food
2922 for distribution to the public, if the food is apparently wholesome
3023 at the time of distribution. This subsection does not apply to an
3124 injury or death that results from an act or omission of the
3225 organization constituting gross negligence, recklessness, or
3326 intentional misconduct.
3427 SECTION 2. The change in law made by this Act applies only
3528 to the donation or distribution of food on or after the effective
3629 date of this Act. The donation or distribution of food before the
3730 effective date of this Act is governed by the law applicable to the
3831 donation or distribution immediately before the effective date of
3932 this Act, and that law is continued in effect for that purpose.
4033 SECTION 3. This Act takes effect immediately if it receives
4134 a vote of two-thirds of all the members elected to each house, as
4235 provided by Section 39, Article III, Texas Constitution. If this
4336 Act does not receive the vote necessary for immediate effect, this
4437 Act takes effect September 1, 2015.
