10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. The heading to Article 102.0178, Code of |
---|
12 | 12 | | Criminal Procedure, is amended to read as follows: |
---|
13 | 13 | | Art. 102.0178. COSTS ATTENDANT TO [CERTAIN INTOXICATION AND |
---|
14 | 14 | | DRUG] CONVICTIONS TO FUND DRUG COURT PROGRAMS. |
---|
15 | 15 | | SECTION 2. Articles 102.0178(a), (e), and (g), Code of |
---|
16 | 16 | | Criminal Procedure, are amended to read as follows: |
---|
17 | 17 | | (a) In addition to other costs on conviction imposed by this |
---|
18 | 18 | | chapter, a person shall pay $60 as a court cost on conviction of an |
---|
19 | 19 | | offense punishable as a Class B misdemeanor or any higher category |
---|
20 | 20 | | of offense [under: |
---|
21 | 21 | | [(1) Chapter 49, Penal Code; or |
---|
22 | 22 | | [(2) Chapter 481, Health and Safety Code]. |
---|
23 | 23 | | (e) A county is entitled to: |
---|
24 | 24 | | (1) if the custodian of the county treasury complies |
---|
25 | 25 | | with Subsection (d), retain 10 percent of the funds collected under |
---|
26 | 26 | | this article by an officer of the county during the calendar quarter |
---|
27 | 27 | | as a service fee; and |
---|
28 | 28 | | (2) if the county has established a drug court |
---|
29 | 29 | | program, including a family drug court program, or establishes a |
---|
30 | 30 | | drug court program before the expiration of the calendar quarter, |
---|
31 | 31 | | retain in addition to the 10 percent authorized by Subdivision (1) |
---|
32 | 32 | | another 70 [50] percent of the funds collected under this article by |
---|
33 | 33 | | an officer of the county during the calendar quarter to be used |
---|
34 | 34 | | exclusively for the development and maintenance of all drug court |
---|
35 | 35 | | programs operated within the county. |
---|
36 | 36 | | (g) The comptroller shall deposit the funds received under |
---|
37 | 37 | | this article to the credit of the drug court account in the general |
---|
38 | 38 | | revenue fund to help fund drug court programs established under |
---|
39 | 39 | | Chapter 122 or[,] 123[, 124, or 125], Government Code, or former |
---|
40 | 40 | | law. The legislature shall appropriate money from the account |
---|
41 | 41 | | solely to the criminal justice division of the governor's office |
---|
42 | 42 | | for distribution to drug court programs that apply for the money. |
---|
43 | 43 | | SECTION 3. Section 102.021, Government Code, is amended to |
---|
44 | 44 | | read as follows: |
