| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 7.056(e), Education Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (e) Except as provided by Subsection (f), a school campus or |
|---|
| 12 | 12 | | district may not receive an exemption or waiver under this section |
|---|
| 13 | 13 | | from: |
|---|
| 14 | 14 | | (1) a prohibition on conduct that constitutes a |
|---|
| 15 | 15 | | criminal offense; |
|---|
| 16 | 16 | | (2) a requirement imposed by federal law or rule, |
|---|
| 17 | 17 | | including a requirement for special education or bilingual |
|---|
| 18 | 18 | | education programs; or |
|---|
| 19 | 19 | | (3) a requirement, restriction, or prohibition |
|---|
| 20 | 20 | | relating to: |
|---|
| 21 | 21 | | (A) essential knowledge or skills under Section |
|---|
| 22 | 22 | | 28.002 or high school graduation requirements under Section 28.025; |
|---|
| 23 | 23 | | (B) public school accountability as provided by |
|---|
| 24 | 24 | | Subchapters B, C, D, E, F, and J, Chapter 39; |
|---|
| 25 | 25 | | (C) extracurricular activities under Section |
|---|
| 26 | 26 | | 33.081 or participation in a University Interscholastic League |
|---|
| 27 | 27 | | area, regional, or state competition under Section 33.0812; |
|---|
| 28 | 28 | | (D) health and safety under Chapter 38; |
|---|

| 47 | 47 | | SECTION 2. Section 25.084(a), Education Code, is amended to |
|---|
| 48 | 48 | | read as follows: |
|---|
| 49 | 49 | | (a) A school district may operate its schools year-round on |
|---|
| 50 | 50 | | either a single-track or a multitrack calendar. If a school |
|---|
| 51 | 51 | | district adopts a year-round system, the district may modify: |
|---|
| 52 | 52 | | (1) the number of contract days of employees and the |
|---|
| 53 | 53 | | number of days of operation, including any time required for staff |
|---|
| 54 | 54 | | development, planning and preparation, and continuing education, |
|---|
| 55 | 55 | | otherwise required by law; |
|---|
| 56 | 56 | | (2) testing dates, data reporting, and related |
|---|
| 57 | 57 | | matters; and |
|---|
| 58 | 58 | | (3) [the date of the first day of instruction of the |
|---|
| 59 | 59 | | school year under Section 25.0811 for a school that was operating |
|---|
| 60 | 60 | | year-round for the 2000-2001 school year; and |
|---|
| 61 | 61 | | [(4)] a student's eligibility to participate in |
|---|
| 62 | 62 | | extracurricular activities when the student's calendar track is not |
|---|
| 63 | 63 | | in session. |
|---|
| 64 | 64 | | SECTION 3. Section 151.326(a), Tax Code, is amended to read |
|---|
| 65 | 65 | | as follows: |
|---|
| 66 | 66 | | (a) The sale of an article of clothing or footwear designed |
|---|
| 67 | 67 | | to be worn on or about the human body is exempted from the taxes |
|---|
| 68 | 68 | | imposed by this chapter if: |
|---|
| 69 | 69 | | (1) the sales price of the article is less than $100; |
|---|
| 70 | 70 | | and |
|---|
| 71 | 71 | | (2) the sale takes place during a period beginning at |
|---|
| 72 | 72 | | 12:01 a.m. on the third Friday in August [before the 15th day |
|---|
| 73 | 73 | | preceding the uniform date prescribed by Section 25.0811(a), |
|---|
| 74 | 74 | | Education Code, without regard to any exception authorized by that |
|---|
| 75 | 75 | | section, before which a school district may not begin instruction |
|---|
| 76 | 76 | | for the school year,] and ending at 12 midnight on the following |
|---|
| 77 | 77 | | Sunday. |
|---|
| 78 | 78 | | SECTION 4. Section 25.0811, Education Code, is repealed. |
|---|
| 79 | 79 | | SECTION 5. This Act takes effect September 1, 2015. |
