55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the first day of the school year for public schools.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 7.056(e), Education Code, is amended to
1010 read as follows:
1111 (e) Except as provided by Subsection (f), a school campus or
1212 district may not receive an exemption or waiver under this section
1313 from:
1414 (1) a prohibition on conduct that constitutes a
1515 criminal offense;
1616 (2) a requirement imposed by federal law or rule,
1717 including a requirement for special education or bilingual
1818 education programs; or
1919 (3) a requirement, restriction, or prohibition
2020 relating to:
2121 (A) essential knowledge or skills under Section
2222 28.002 or high school graduation requirements under Section 28.025;
2323 (B) public school accountability as provided by
2424 Subchapters B, C, D, E, F, and J, Chapter 39;
2525 (C) extracurricular activities under Section
2626 33.081 or participation in a University Interscholastic League
2727 area, regional, or state competition under Section 33.0812;
2828 (D) health and safety under Chapter 38;
2929 (E) purchasing under Subchapter B, Chapter 44;
3030 (F) elementary school class size limits, except
3131 as provided by Section 25.112;
3232 (G) removal of a disruptive student from the
3333 classroom under Subchapter A, Chapter 37;
3434 (H) at-risk programs under Subchapter C, Chapter
3535 29;
3636 (I) prekindergarten programs under Subchapter E,
3737 Chapter 29;
3838 (J) educator rights and benefits under
3939 Subchapters A, C, D, E, F, G, and I, Chapter 21, or under Subchapter
4040 A, Chapter 22;
4141 (K) special education programs under Subchapter
4242 A, Chapter 29; or
4343 (L) bilingual education programs under
4444 Subchapter B, Chapter 29[; or
4545 [(M) the requirements for the first day of
4646 instruction under Section 25.0811].
4747 SECTION 2. Section 25.084(a), Education Code, is amended to
4848 read as follows:
4949 (a) A school district may operate its schools year-round on
5050 either a single-track or a multitrack calendar. If a school
5151 district adopts a year-round system, the district may modify:
5252 (1) the number of contract days of employees and the
5353 number of days of operation, including any time required for staff
5454 development, planning and preparation, and continuing education,
5555 otherwise required by law;
5656 (2) testing dates, data reporting, and related
5757 matters; and
5858 (3) [the date of the first day of instruction of the
5959 school year under Section 25.0811 for a school that was operating
6060 year-round for the 2000-2001 school year; and
6161 [(4)] a student's eligibility to participate in
6262 extracurricular activities when the student's calendar track is not
6363 in session.
6464 SECTION 3. Section 151.326(a), Tax Code, is amended to read
6565 as follows:
6666 (a) The sale of an article of clothing or footwear designed
6767 to be worn on or about the human body is exempted from the taxes
6868 imposed by this chapter if:
6969 (1) the sales price of the article is less than $100;
7070 and
7171 (2) the sale takes place during a period beginning at
7272 12:01 a.m. on the third Friday in August [before the 15th day
7373 preceding the uniform date prescribed by Section 25.0811(a),
7474 Education Code, without regard to any exception authorized by that
7575 section, before which a school district may not begin instruction
7676 for the school year,] and ending at 12 midnight on the following
7777 Sunday.
7878 SECTION 4. Section 25.0811, Education Code, is repealed.
7979 SECTION 5. This Act takes effect September 1, 2015.
