| 7 | 7 | | relating to increasing the criminal penalty for the offense of |

| 8 | 8 | | obstructing a highway or other passageway. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 42.03(c), Penal Code, is amended to read |
|---|
| 11 | 11 | | as follows: |
|---|
| 12 | 12 | | (c) An offense under this section is a Class B misdemeanor, |
|---|
| 13 | 13 | | except that the offense is a Class A misdemeanor if, in committing |
|---|
| 14 | 14 | | the offense, the actor used a device that is intended to hinder |
|---|
| 15 | 15 | | removal of an obstruction. |
|---|
| 16 | 16 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 17 | 17 | | to an offense committed on or after the effective date of this Act. |
|---|
| 18 | 18 | | An offense committed before the effective date of this Act is |
|---|
| 19 | 19 | | governed by the law in effect on the date the offense was committed, |
|---|
| 20 | 20 | | and the former law is continued in effect for that purpose. For |
|---|
| 21 | 21 | | purposes of this section, an offense was committed before the |
|---|
| 22 | 22 | | effective date of this Act if any element of the offense occurred |
|---|
| 23 | 23 | | before that date. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect September 1, 2015. |
