66 AN ACT
77 relating to the establishment of the Texas Technical Center for
88 Innovative Desalination at The University of Texas at El Paso in
99 partnership with The University of Texas at San Antonio.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 69, Education Code, is amended by adding
1212 Subchapter C to read as follows:
1313 SUBCHAPTER C. TEXAS TECHNICAL CENTER FOR INNOVATIVE
1414 DESALINATION
1515 Sec. 69.51. DEFINITION. In this subchapter, "center" means
1616 the Texas Technical Center for Innovative Desalination established
1717 under this subchapter.
1818 Sec. 69.52. ESTABLISHMENT. (a) The Texas Technical Center
1919 for Innovative Desalination is established as a joint partnership
2020 of The University of Texas at El Paso and The University of Texas at
2121 San Antonio.
2222 (b) The organization, control, and management of the center
2323 are vested in the board. The University of Texas at El Paso shall
2424 administer the programs of the center.
2525 (c) The center shall operate through The University of Texas
2626 at El Paso's College of Engineering and The University of Texas at
2727 San Antonio's College of Engineering. Participation in the
2828 center's activities shall be open to any faculty member of either
2929 university who is an active researcher in the field of water
3030 desalination, engineering, hydrology, biology, water supply
3131 development, energy efficiency, materials management, or another
3232 relevant field as determined by the board.
3333 Sec. 69.53. PURPOSE. The center is created to:
3434 (1) promote interdisciplinary research, education,
3535 and training for the development of state-of-the-art products,
3636 materials, systems, and technologies designed for the desalination
3737 of seawater from the Gulf of Mexico and brackish water within
3838 surface and groundwater resources throughout the state;
3939 (2) develop cost-effective, energy-efficient, and
4040 environmentally sound water desalination, brine disposal, and
4141 water conveyance technologies that can enhance the potential for
4242 desalinated water to contribute toward the state's long-term water
4343 portfolio; and
4444 (3) develop and make available pertinent technical,
4545 legal, and policy documents to advance the public's awareness about
4646 the cost, usefulness, and applications of water desalination.
4747 Sec. 69.54. POWERS AND DUTIES. The center shall:
4848 (1) collaborate with appropriate international,
4949 federal, state, and local agencies and private business or
5050 nonprofit entities as necessary to develop innovative desalination
5151 technologies;
5252 (2) research and develop innovative seawater and
5353 brackish water desalination technologies, including pretreatment
5454 technologies and improvements, that:
5555 (A) are cost effective and energy efficient;
5656 (B) minimize environmental impacts; and
5757 (C) offer long-term water supply solutions for
5858 the state;
5959 (3) research and develop innovative concentrate and
6060 brine disposal methods and technologies that ensure responsible
6161 environmental stewardship and create commercial markets for
6262 by-products;
6363 (4) research and develop water conveyance systems and
6464 technologies that may be used to transport desalinated water to
6565 target use populations;
6666 (5) develop test facilities for evaluating the
6767 performance of new products, materials, or techniques;
6868 (6) develop specifications and standards for products
6969 used for desalinating water, conveying water, and disposing of
7070 concentrate or brine;
7171 (7) provide public information, education, and
7272 outreach regarding desalination technologies and appropriate uses
7373 and conservation methods for desalinated water;
7474 (8) provide data, recommendations, and any other
7575 information necessary relating to desalination for local,
7676 regional, or statewide water planning programs and processes;
7777 (9) organize and host seminars and conferences
7878 educating water utilities, educators, regulatory agencies, and
7979 private entities on the center's work;
8080 (10) research and develop brackish water systems that:
8181 (A) are water and energy efficient; and
8282 (B) could meet the demands of numerous small and
8383 rural communities in the state; and
8484 (11) advise state and federal agencies on the
8585 inventory of the state's brackish water resources, including
8686 brackish water resources located near the Texas-Mexico border.
8787 Sec. 69.55. COLLABORATION WITH OTHER ENTITIES. The
8888 University of Texas at El Paso and The University of Texas at San
8989 Antonio shall encourage public, private, and nonprofit entities to
9090 participate in or support the operation of the center and may enter
9191 into an agreement with any public, private, or nonprofit entity for
9292 that purpose. An agreement may allow the center to provide
9393 information, services, or other assistance to an entity in exchange
9494 for the entity's participation or support. The center shall
9595 solicit active participation by researchers at other universities
9696 and laboratories for the purposes of this subchapter.
9797 Sec. 69.56. GIFTS AND GRANTS. The board shall solicit,
9898 accept, and administer gifts and grants from any public or private
9999 source, including local, state, and federal agencies, for the
100100 purposes of this subchapter.
101101 Sec. 69.57. PERSONNEL. The board may employ personnel for
102102 the center as the board considers necessary.
103103 SECTION 2. This Act takes effect immediately if it receives
104104 a vote of two-thirds of all the members elected to each house, as
105105 provided by Section 39, Article III, Texas Constitution. If this
106106 Act does not receive the vote necessary for immediate effect, this
107107 Act takes effect September 1, 2015.
