55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution of certain offenses involving the
88 delivery or possession of controlled substances and other
99 prohibited drugs, substances, or paraphernalia.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 481.112, Health and Safety Code, is
1212 amended by adding Subsection (g) to read as follows:
1313 (g) It is an exception to the application of an offense
1414 punishable under Subsection (b), other than an offense committed by
1515 manufacturing a controlled substance, that the actor:
1616 (1) requested emergency medical assistance in
1717 response to the possible controlled substance overdose of another
1818 person;
1919 (2) was the first person to make a request for medical
2020 assistance under Subdivision (1);
2121 (3) remained on the scene until the medical assistance
2222 arrived; and
2323 (4) cooperated with medical assistance and law
2424 enforcement personnel.
2525 SECTION 2. Section 481.1121, Health and Safety Code, is
2626 amended by adding Subsection (c) to read as follows:
2727 (c) It is an exception to the application of an offense
2828 punishable under Subsection (b)(1), other than an offense committed
2929 by manufacturing a controlled substance, that the actor:
3030 (1) requested emergency medical assistance in
3131 response to the possible controlled substance overdose of another
3232 person;
3333 (2) was the first person to make a request for medical
3434 assistance under Subdivision (1);
3535 (3) remained on the scene until the medical assistance
3636 arrived; and
3737 (4) cooperated with medical assistance and law
3838 enforcement personnel.
3939 SECTION 3. Section 481.113, Health and Safety Code, is
4040 amended by adding Subsection (f) to read as follows:
4141 (f) It is an exception to the application of an offense
4242 punishable under Subsection (b), other than an offense committed by
4343 manufacturing a controlled substance, that the actor:
4444 (1) requested emergency medical assistance in
4545 response to the possible controlled substance overdose of another
4646 person;
4747 (2) was the first person to make a request for medical
4848 assistance under Subdivision (1);
4949 (3) remained on the scene until the medical assistance
5050 arrived; and
5151 (4) cooperated with medical assistance and law
5252 enforcement personnel.
5353 SECTION 4. Section 481.114, Health and Safety Code, is
5454 amended by adding Subsection (f) to read as follows:
5555 (f) It is an exception to the application of an offense
5656 punishable under Subsection (b), other than an offense committed by
5757 manufacturing a controlled substance, that the actor:
5858 (1) requested emergency medical assistance in
5959 response to the possible controlled substance overdose of another
6060 person;
6161 (2) was the first person to make a request for medical
6262 assistance under Subdivision (1);
6363 (3) remained on the scene until the medical assistance
6464 arrived; and
6565 (4) cooperated with medical assistance and law
6666 enforcement personnel.
6767 SECTION 5. Section 481.115, Health and Safety Code, is
6868 amended by adding Subsection (g) to read as follows:
6969 (g) It is an exception to the application of an offense
7070 punishable under Subsection (b) that the actor:
7171 (1) requested emergency medical assistance in
7272 response to the possible controlled substance overdose of another
7373 person;
7474 (2) was the first person to make a request for medical
7575 assistance under Subdivision (1);
7676 (3) remained on the scene until the medical assistance
7777 arrived; and
7878 (4) cooperated with medical assistance and law
7979 enforcement personnel.
8080 SECTION 6. Section 481.1151, Health and Safety Code, is
8181 amended by adding Subsection (c) to read as follows:
8282 (c) It is an exception to the application of an offense
8383 punishable under Subsection (b)(1) that the actor:
8484 (1) requested emergency medical assistance in
8585 response to the possible controlled substance overdose of another
8686 person;
8787 (2) was the first person to make a request for medical
8888 assistance under Subdivision (1);
8989 (3) remained on the scene until the medical assistance
9090 arrived; and
9191 (4) cooperated with medical assistance and law
9292 enforcement personnel.
9393 SECTION 7. Section 481.116, Health and Safety Code, is
9494 amended by adding Subsection (f) to read as follows:
9595 (f) It is an exception to the application of an offense
9696 punishable under Subsection (b) that the actor:
9797 (1) requested emergency medical assistance in
9898 response to the possible controlled substance overdose of another
9999 person;
100100 (2) was the first person to make a request for medical
101101 assistance under Subdivision (1);
102102 (3) remained on the scene until the medical assistance
103103 arrived; and
104104 (4) cooperated with medical assistance and law
105105 enforcement personnel.
106106 SECTION 8. Section 481.1161, Health and Safety Code, is
107107 amended by adding Subsection (c) to read as follows:
108108 (c) It is an exception to the application of an offense
109109 punishable under Subsection (b)(1) or (2) that the actor:
110110 (1) requested emergency medical assistance in
111111 response to the possible controlled substance overdose of another
112112 person;
113113 (2) was the first person to make a request for medical
114114 assistance under Subdivision (1);
115115 (3) remained on the scene until the medical assistance
116116 arrived; and
117117 (4) cooperated with medical assistance and law
118118 enforcement personnel.
119119 SECTION 9. Section 481.117, Health and Safety Code, is
120120 amended by adding Subsection (f) to read as follows:
121121 (f) It is an exception to the application of an offense
122122 punishable under Subsection (b) that the actor:
123123 (1) requested emergency medical assistance in
124124 response to the possible controlled substance overdose of another
125125 person;
126126 (2) was the first person to make a request for medical
127127 assistance under Subdivision (1);
128128 (3) remained on the scene until the medical assistance
129129 arrived; and
130130 (4) cooperated with medical assistance and law
131131 enforcement personnel.
132132 SECTION 10. Section 481.118, Health and Safety Code, is
133133 amended by adding Subsection (f) to read as follows:
134134 (f) It is an exception to the application of an offense
135135 punishable under Subsection (b) that the actor:
136136 (1) requested emergency medical assistance in
137137 response to the possible controlled substance overdose of another
138138 person;
139139 (2) was the first person to make a request for medical
140140 assistance under Subdivision (1);
141141 (3) remained on the scene until the medical assistance
142142 arrived; and
143143 (4) cooperated with medical assistance and law
144144 enforcement personnel.
145145 SECTION 11. Section 481.119, Health and Safety Code, is
146146 amended by adding Subsection (c) to read as follows:
147147 (c) It is an exception to the application of an offense
148148 under Subsection (a) or (b), other than an offense committed by
149149 manufacturing a controlled substance, that the actor:
150150 (1) requested emergency medical assistance in
151151 response to the possible controlled substance overdose of another
152152 person;
153153 (2) was the first person to make a request for medical
154154 assistance under Subdivision (1);
155155 (3) remained on the scene until the medical assistance
156156 arrived; and
157157 (4) cooperated with medical assistance and law
158158 enforcement personnel.
159159 SECTION 12. Section 481.120, Health and Safety Code, is
160160 amended by adding Subsection (c) to read as follows:
161161 (c) It is an exception to the application of an offense
162162 punishable under Subsection (b)(1) or (2) that the actor:
163163 (1) requested emergency medical assistance in
164164 response to the possible controlled substance overdose of another
165165 person;
166166 (2) was the first person to make a request for medical
167167 assistance under Subdivision (1);
168168 (3) remained on the scene until the medical assistance
169169 arrived; and
170170 (4) cooperated with medical assistance and law
171171 enforcement personnel.
172172 SECTION 13. Section 481.121, Health and Safety Code, is
173173 amended by adding Subsection (c) to read as follows:
174174 (c) It is an exception to the application of an offense
175175 punishable under Subsection (b)(1) or (2) that the actor:
176176 (1) requested emergency medical assistance in
177177 response to the possible controlled substance overdose of another
178178 person;
179179 (2) was the first person to make a request for medical
180180 assistance under Subdivision (1);
181181 (3) remained on the scene until the medical assistance
182182 arrived; and
183183 (4) cooperated with medical assistance and law
184184 enforcement personnel.
185185 SECTION 14. Section 481.122, Health and Safety Code, is
186186 amended by adding Subsection (c-1) to read as follows:
187187 (c-1) It is an exception to the application of this section
188188 that the actor:
189189 (1) requested emergency medical assistance in
190190 response to the possible controlled substance overdose of another
191191 person;
192192 (2) was the first person to make a request for medical
193193 assistance under Subdivision (1);
194194 (3) remained on the scene until the medical assistance
195195 arrived; and
196196 (4) cooperated with medical assistance and law
197197 enforcement personnel.
198198 SECTION 15. Section 481.125, Health and Safety Code, is
199199 amended by adding Subsection (g) to read as follows:
200200 (g) It is an exception to the application of Subsection (a)
201201 or an offense under Subsection (b), other than an offense committed
202202 by manufacturing drug paraphernalia, that the actor:
203203 (1) requested emergency medical assistance in
204204 response to the possible controlled substance overdose of another
205205 person;
206206 (2) was the first person to make a request for medical
207207 assistance under Subdivision (1);
208208 (3) remained on the scene until the medical assistance
209209 arrived; and
210210 (4) cooperated with medical assistance and law
211211 enforcement personnel.
212212 SECTION 16. Section 483.041, Health and Safety Code, is
213213 amended by adding Subsection (e) to read as follows:
214214 (e) It is an exception to the application of Subsection (a)
215215 that the actor:
216216 (1) requested emergency medical assistance in
217217 response to the possible dangerous drug overdose of another person;
218218 (2) was the first person to make a request for medical
219219 assistance under Subdivision (1);
220220 (3) remained on the scene until the medical assistance
221221 arrived; and
222222 (4) cooperated with medical assistance and law
223223 enforcement personnel.
224224 SECTION 17. Section 483.042, Health and Safety Code, is
225225 amended by adding Subsection (g) to read as follows:
226226 (g) It is an exception to the application of this section
227227 that the actor:
228228 (1) requested emergency medical assistance in
229229 response to the possible dangerous drug overdose of another person;
230230 (2) was the first person to make a request for medical
231231 assistance under Subdivision (1);
232232 (3) remained on the scene until the medical assistance
233233 arrived; and
234234 (4) cooperated with medical assistance and law
235235 enforcement personnel.
236236 SECTION 18. Section 485.031, Health and Safety Code, is
237237 amended by adding Subsection (c) to read as follows:
238238 (c) It is an exception to the application of this section
239239 that the actor:
240240 (1) requested emergency medical assistance in
241241 response to the possible abusable volatile chemical overdose of
242242 another person;
243243 (2) was the first person to make a request for medical
244244 assistance under Subdivision (1);
245245 (3) remained on the scene until the medical assistance
246246 arrived; and
247247 (4) cooperated with medical assistance and law
248248 enforcement personnel.
249249 SECTION 19. Section 485.032, Health and Safety Code, is
250250 amended by adding Subsection (c-1) to read as follows:
251251 (c-1) It is an exception to the application of this section
252252 that the actor:
253253 (1) requested emergency medical assistance in
254254 response to the possible abusable volatile chemical overdose of
255255 another person;
256256 (2) was the first person to make a request for medical
257257 assistance under Subdivision (1);
258258 (3) remained on the scene until the medical assistance
259259 arrived; and
260260 (4) cooperated with medical assistance and law
261261 enforcement personnel.
262262 SECTION 20. Section 485.033, Health and Safety Code, is
263263 amended by adding Subsection (d) to read as follows:
264264 (d) It is an exception to the application of Subsection (a)
265265 or an offense under Subsection (b), other than an offense committed
266266 by manufacturing inhalant paraphernalia, that the actor:
267267 (1) requested emergency medical assistance in
268268 response to the possible abusable volatile chemical overdose of
269269 another person;
270270 (2) was the first person to make a request for medical
271271 assistance under Subdivision (1);
272272 (3) remained on the scene until the medical assistance
273273 arrived; and
274274 (4) cooperated with medical assistance and law
275275 enforcement personnel.
276276 SECTION 21. The change in law made by this Act applies only
277277 to an offense committed on or after the effective date of this Act.
278278 An offense committed before the effective date of this Act is
279279 governed by the law in effect on the date the offense was committed,
280280 and the former law is continued in effect for that purpose. For
281281 purposes of this section, an offense was committed before the
282282 effective date of this Act if any element of the offense occurred
283283 before that date.
284284 SECTION 22. This Act takes effect September 1, 2015.
