9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 25.094, Education Code, is amended by | |
11 | 11 | adding Subsection (h) to read as follows: | |
12 | 12 | (h) Notwithstanding any other law, an individual found in | |
13 | 13 | contempt of court, or adjudicated to have engaged in delinquent | |
14 | 14 | conduct that would constitute contempt of court, for failure to | |
15 | 15 | obey a court order related to an offense under Subsection (a) may | |
16 | 16 | not be punished for the contempt or delinquent conduct by | |
17 | 17 | confinement in jail or detention in a juvenile detention facility. | |
18 | 18 | SECTION 2. The change in law made by this Act applies only | |
19 | 19 | to conduct that would constitute contempt of court that occurs on or | |
20 | 20 | after the effective date of this Act. Conduct that would constitute | |
21 | 21 | contempt of court that occurred before the effective date of this | |
22 | 22 | Act is governed by the law in effect on the date the conduct | |
23 | 23 | occurred, and the former law is continued in effect for that | |
24 | 24 | purpose. For purposes of this section, conduct occurred before the | |
25 | 25 | effective date of this Act if any element of the conduct occurred | |
26 | 26 | before that date. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2015. |
